Prior to the adoption of Ord. 16334 on 02/07/2000, Section 11-276 read as follows.


    For the purpose of this article, the following terms, phrases, words and their derivations shall have the meanings given herein:

    Ancillary commercial pool. A swimming pool maintained as an ancillary service of a hotel, motel, apartment building or multiple-family dwelling and for which memberships or admissions are sold to the general public.

    Family pool. A body of water and auxiliary structures operated and maintained in conjunction with a community association, or operated and maintained at a private residence, and intended only for the use of the owner or owners and invited guests.

    Health department. The health department of the City of Columbia, Missouri.

    Swimming pool. An artificial or natural receptacle containing a body of water, whether located indoors or outdoors, used or intended to be used for public, semi-public or private swimming, whether or not any charge or fee is imposed for such uses, operated and maintained by any person, firm, partnership, association, corporation, company or any organization of any kind, including all swimming pools operated and maintained in conjunction with or by clubs, motels and hotels. The term shall include all structures, appurtenances, equipment, appliances and other facilities appurtenant to and intended for the operation and maintenance of a swimming pool, excluding family pools as defined herein.

    The following definitions apply to this article:

    Spa.  A spa is a swimming pool designed for recreational or therapeutic use of heated water and not to be drained, cleaned, and refilled for each individual.  A spa may include hydrojet circulation, mineral baths and an air induction system.  A pool used under direct supervision of qualified medical personnel is not a spa.

    Swimming pool.  Any artificial basin of water which has been wholly designed, modified, improved, constructed or installed solely for the purpose of swimming, wading or immersion.

    Swimming Pools shall be divided into the following classes:

    (A)  Class A swimming pool is a swimming pool operated by the city or any other governmental agency.

    (B)  Class B swimming pool is a swimming pool operated by a hotel, motel, community association, apartment complex or similar entity which serves merely as an additional service for patrons or residents and which is not otherwise classified as Class C.

    (C)  Class C swimming pool is a swimming pool that is maintained by a commercial establishment for which memberships or admissions are sold.

    (D) Class D swimming pool is a private, residential swimming pool or spa.

    (E)  Class E swimming pool is a non-residential spa.

        (F)    Class F swimming pool is a special purpose pool that has a special use or design such as a wave pool, wading pool, zero-depth entry pool and pool with a water slide.
