Section 11-46 Created; composition; compensation; terms; vacancies.
Prior to the adoption of Ord. 17658 on 04/21/2003, Section 11-46 read as follows.
(a) There shall be a nine (9) member board of health which shall be composed
of two (2)
physicians, a veterinarian, a nurse, a dentist, and two (2) other lay persons, all
of whom shall be
registered, qualified voters of the city, who shall be appointed by the city council. Two (2)
additional members, registered, qualified voters of the county, shall be appointed by the county
court commission. All members shall serve without compensation for a term of
three (3) years
and until the successors are appointed and qualified; provided, that the first two (2) appointments
by the county court shall be for terms of two (2) and three (3) years respectively.
(b) Any board member having three (3) unscheduled absences without just
cause within a
period of one year, or who shall be continuously absent from meetings for any reason for a
period of four (4) months (when regular meetings have been held in such four (4) months)
without prior city council or county court consent, shall automatically forfeit his office. The
chair
of the board is authorized to excuse any member from attendance at a board meeting; provided,
that the member requested to be excused before the meeting. Any member who is absent,
without being excused, from twenty-five percent of the regular board meetings held in a calendar
year shall automatically forfeit the office. Any member who is absent, without being excused,
from three consecutive regular meetings shall automatically forfeit the office. It shall be
the duty
of the chairman of the board to promptly notify the city council or the county court commission
of the vacancy.
