(a) A retailer may refuse to accept from any person, and a distributor may refuse to accept from any retailer, any empty beverage container not marked in the manner provided in section 11-64.

    (b) A retailer may refuse to accept any beverage container which is broken or not clean.

    (c) A retailer or distributor may refuse to accept any beverage container which is of a different type, style or brand of manufacture than those offered for sale by the retailer or distributor. A beverage container shall be of the type, style or brand of manufacture sold by the retailer if it has been sold or offered for sale within the six (6) months immediately preceding the date of its return for refund.
