(a)  Any person violating any provision of this division shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished as provided in section 1-8 of this Code.

    (b)  Any person convicted of violating section 13-259 shall be punished as provided in section 1-8 of this Code, but in no event shall the fine be less than one hundred dollars ($100.00).
