Section 100-055 Ord. 15894; Rezoning Property Between Westwind Drive and Barberry Avenue (Homeview Properties, Strothman)

AN ORDINANCE

rezoning property located between Westwind Drive and Barberry Avenue from District A-1 to District R-1 and from Districts A-1 and R-1 to District R-2; setting forth conditions to the rezoning; and fixing the time when this ordinance shall become effective.

The Zoning District Map established and adopted by Section 294 of the Code of Ordinances of the City of Columbia, Missouri, is amended so that the following property:

will be rezoned and become a part of District R-1 (One-Family Dwelling District) and taken away from District A-1 (Agricultural District).

The Zoning District Map established and adopted by Section 294 of the Code of Ordinances of the City of Columbia, Missouri, is amended so that the following property:

will be rezoned and become a part of District R-2 (Two-Family Dwelling District) and taken away from Districts A-1 (Agricultural District) and R-1 (One-Family Dwelling District).

The rezoning of the property described in sections 1 and 2 (“the subject tract”) is subject to the following conditions which have been agreed to by the property owner:

    a.    No more than 24 lots shall be platted on the property described in section 2.

    b.    No street connection shall be made from the subject tract to Westwind Drive until a route over improved streets is available from the subject tract over any part of Westwind Drive to I-70 Drive Northwest.

    c.    Preliminary and Final Plats of the subject tract shall provide for street connections to Westwind Drive and to the property west of the subject tract.

    d.    The Final Plat of the subject tract shall show a public pedestrian walkway along Barberry Avenue on the north side of the subject tract. This walkway shall be landscaped.
    
    e.    Prior to approval of the Final Plat, property owner shall file restrictive covenants on the subject tract which provide for two (2) trees in each front yard in the subdivision, professional lawn service for lots in the subdivision, architectural review of structures built in the subdivision and varied front elevations of houses in the subdivision.
