Section 101-001 Ord. 16299; Construction of Improvements to City Property Located Adjacent to MKT Trail, East of Scott Boulevard (Baurichter Property)

AN ORDINANCE
declaring it is in the public interest to proceed with construction of improvements
to the City
property located adjacent to the MKT Trail, east of Scott Boulevard; approving plans and
specifications for the improvements; calling for bids through the Purchasing Division;
determining that a portion of the project shall be done by city employees; providing for payment
for the improvement; providing for compliance with the prevailing wage law; and fixing the time
when this ordinance shall become effective.
SECTION 1. Subsequent to the adoption of a resolution
by the City Council, declaring the
necessity for construction of improvements to the City property located adjacent to the MKT
Trail, east of Scott Boulevard and pursuant to the publication of the resolution in a daily
newspaper of general circulation in the City of Columbia, Missouri, and the affidavit of
publication filed; and after a public hearing as provided for in Section 75 of the Home Rule
Charter, the Council finds and determines that construction of such improvements, including the
development of an access road and parking lot, grading of the site for open space recreation
practice fields and planting trees, is necessary for the welfare and improvement of the city and
that it is in the public interest that such improvements be made.
SECTION 2. The plans and specifications for these improvements
filed in the office of the
city clerk, are hereby approved, adopted and made a part hereof by reference as fully as if set
forth herein verbatim.
SECTION 3. The City Manager, through the head of the purchasing
division, is hereby
authorized to call for bids for the development of the parking lot and grading the site for open
space recreation practice fields. The City Manager is hereby authorized to execute a contract
for
these improvements. As deemed advisable by the City Manager pursuant to Section 70 of the
City Charter, city employees shall be used for the development of the access road and the tree
plantings.
SECTION 4. Payment for this improvement shall be made from the
Public Improvement Fund,
and such other funds as may be lawfully appropriated.
SECTION 5. The City shall cause to be inserted into the
contract a stipulation to the effect
that not less than the prevailing hourly rate of wages, as found by the Department of Labor and
Industrial Relations of Missouri, shall be paid to all workers performing work under the contract.
The contractor's bond shall include such provisions as will guarantee the faithful performance of
the prevailing hourly wage clause, as provided by the contract.
SECTION 6. This ordinance shall be in full force and effect
from and after its passage.
