Section 101-012 Ord. 16310; Rezoning Property Located on the NW Corner of McKee Street and Alan Lane from R-2 to PUD-7; Approving PUD Site Plan of McKee Estates

AN ORDINANCE

rezoning property located on the northwest corner of McKee Street and Alan Lane from District R-2 to District PUD-7; approving the PUD site plan of McKee Estates;  repealing all conflicting ordinances or parts of ordinances; and fixing the time when this ordinance shall become effective.

    SECTION 1.  The Zoning District Map established and adopted by Section 294 of the Code of Ordinances of the City of Columbia, Missouri, is amended so that the following property:
        
A part of the southeast quarter (SE1/4) of Section Four (4), Township Forty-Eight (48), Range Twelve (12), more particularly described as follows: Beginning at a point on the north line of County Survey #1743 a distance of 496 feet from the northwest corner; thence with the north line of said survey S85E44'E, 292 feet to an iron; thence south 906.9 feet to an iron; thence N70E56'W, 154.4 feet to an iron at the southeast corner of Tract #2 of County Survey #7349; thence with said survey north 150 feet to an iron; thence N70E56'W, 153.7 feet to an iron at the northwest corner of said Tract #2; thence north 678.0 feet to the beginning, except the east 25 feet of the above described tract conveyed to the City of Columbia, Missouri, for street purposes by instrument recorded in Book 403, Page 142, Records of Boone County, Missouri.

Also, Tract #2 in County Survey #7439, beginning at an iron (1) set 867 feet south and 495.6 feet east of the northwest corner of Survey #1743; thence north 150 feet to an iron; thence S70E56'E, 153.7 feet to an iron at (3); thence south 150 feet to an iron at (4); thence N70E56'W, 153.7 feet to the point of beginning.

will be rezoned and become a part of District PUD (Planned Unit Development) with a development density not exceeding seven dwelling units per acre and taken away from District R-2 (Two-Family Dwelling District).  The zoning district map shall designate the property PUD-7.  Hereafter the property may be used for one-family dwellings and apartment houses.  The statement of intent submitted by applicant, marked “Exhibit A” is attached to and made a part of this ordinance.

    SECTION 2.  The City Council hereby approves the McKee Estates PUD site plan for the property referenced in Section 1 above.

    SECTION 3.  All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

    SECTION 4.  This ordinance shall be in full force and effect from and after its passage.
