AN ORDINANCE
authorizing the City Manager to apply to the United States Department of Transportation
and the
Missouri Department of Transportation for transit operating and capital assistance grants;
authorizing the Public Works Director to furnish information; authorizing the City Manager to
execute certifications and assurances; authorizing the City Manager to execute grant agreements;
authorizing electronic filings; and fixing the time when this ordinance shall become effective.
WHEREAS, the City of Columbia operates a
municipal transit system; and
WHEREAS, Section 5307 and Section 5309, Title 49 of the United
States Code (U.S.C.)
authorize the Secretary of Transportation to provide grants for mass transportation projects; and
WHEREAS, if the City receives a grant from the U.S. Department
of Transportation, the
contract for financial assistance will impose certain obligations upon the City, including the
obligation to provide the local share of project costs; and
WHEREAS, pursuant to the provisions or Title VI of the Civil
Rights Act of 1964, the
Department of Transportation, in conjunction with the filing of applications for assistance under
Title 53 U.S.C. requires an applicant to provide assurances that it will comply with Title VI of
the Civil Rights Act of 1964 and the Department of Transportation's requirements under Title 53
U.S.C.; and
WHEREAS, the Missouri Department of Transportation administers
Federal Transit
Administration Section 5307 and Section 5309 funding.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA,
MISSOURI, AS FOLLOWS:
SECTION 1. The City Manager is authorized
to apply to the U.S. Department of
Transportation and the Missouri Department of Transportation, on behalf of the City of
Columbia, for operating and capital assistance grants to aid in financing the Citys transit
operations.
Section 2. The Public Works Director or the Directors
appointed designee, acting as the City
Managers representative, is authorized to furnish any additional information required by the
Department of Transportation in conjunction with the grant application and management.
Section 3. The City Manager is authorized to execute and
file with the Federal Transit
Administration and the Missouri Department of Transportation the required certifications and
assurances and any other documents required by the U.S. Department of Transportation to satisfy
the requirements of Title VI of the Civil Rights Act of 1964.
Section 4. The City Manager is authorized to execute a
grant agreement with the U.S.
Department of Transportation, on behalf of the City of Columbia, for aid in financing transit
operations and capital improvements. The City Manager is further authorized to execute
supplemental grant agreements for additional grants that may become available during the
current federal fiscal year.
Section 5. The Public Works Director or the Directors
appointed designee is authorized to
review and submit electronically to the Federal Transit Administration grant applications,
quarterly reports, and any other required information.
Section 6. This ordinance shall be in full force and effect
from and after its passage.
