AN ORDINANCE
authorizing an agreement with Westbury Joint Venture and Hamlet Homes Association;
declaring it is in the public interest to proceed with construction of storm drainage
improvements in The Hamlet Subdivision; approving plans and specifications for the
improvements; determining that the work shall be done by City employees; providing for
payment for the improvement; appropriating funds; and fixing the time when this ordinance shall
become effective.
SECTION 1. The City Manager is hereby authorized to execute
an agreement with Westbury
Joint Venture and Hamlet Homes Association. The form and content of the agreement shall be
substantially as set forth in "Attachment A" attached hereto and made a part hereof as fully
as if
set forth herein verbatim.
SECTION 2. Subsequent to the adoption of a resolution
by the City Council, declaring the
necessity for construction of storm drainage improvements in The Hamlet Subdivision and
pursuant to the publication of the resolution in a daily newspaper of general circulation in the
City of Columbia, Missouri, and the affidavit of publication filed; and after a public hearing as
provided for in Section 75 of the Home Rule Charter, the Council finds and determines
construction of such improvements, including pipe extensions, grading, excavating and
stabilization of a drainage channel using interlocking blocks and segmental retaining wall
together with miscellaneous work, is necessary for the welfare and improvement of the City and
that it is in the public interest that such improvements be made.
SECTION 3. The plans and specifications for these improvements
as prepared by the
Department of Public Works and filed in the office of the City Clerk, are hereby approved,
adopted and made a part hereof by reference as fully as if set forth herein verbatim.
SECTION 4. As deemed advisable by the City Manager pursuant
to Section 70 of the City
Charter, City employees shall be used to construct the improvements.
SECTION 5. Payment for this improvement shall be made
from the storm water utility fund,
private funds and such other funds as may be lawfully appropriated.
SECTION 6. The sum of $ 185,000 is hereby appropriated
from the Storm Water Utility Fund
Account No. 558-0000-351.01-00 to the Hamlet Subdivision Drainage Project Account No. 558-6688-881.49-90

SECTION 7. This ordinance shall be in full force and effect
from and after its passage.
