AN ORDINANCE
declaring it is in the public interest to proceed with construction of improvements
to Again Street
Park; approving plans and specifications for the improvements; calling for bids through the
Purchasing Division; determining that a portion of the project shall be done by city employees;
providing for payment for the improvement; providing for compliance with the prevailing wage
law; and fixing the time when this ordinance shall become effective.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS
FOLLOWS:
SECTION 1. Subsequent to the adoption of a resolution
by the City Council, declaring the
necessity for construction of improvements to Again Street Park and pursuant to the publication
of the resolution in a daily newspaper of general circulation in the City of Columbia, Missouri,
and the affidavit of publication filed; and after a public hearing as provided for in Section 75 of
the Home Rule Charter, the Council finds and determines that construction of such
improvements, including the replacement of permanent fencing on the baseball/softball field and
the installation of a drinking fountain, is necessary for the welfare and improvement of the city
and that it is in the public interest that such improvements be made.
SECTION 2. The plans and specifications for these improvements
filed in the office of the
city clerk, are hereby approved, adopted and made a part hereof by reference as fully as if set
forth herein verbatim.
SECTION 3. The City Manager, through the head of the purchasing
division, is hereby
authorized to call for bids for the replacement of permanent fencing on the baseball/softball field.
The City Manager is hereby authorized to execute a contract for this improvement. As deemed
advisable by the City Manager pursuant to Section 70 of the City Charter, city employees shall
be used for the installation of the drinking fountain.
SECTION 4. Payment for this improvement shall be made from Community
Development
Block Grant Funds, and such other funds as may be lawfully appropriated.
SECTION 5. The City shall cause to be inserted into the
contract a stipulation to the effect
that not less than the prevailing hourly rate of wages, as found by the Department of Labor and
Industrial Relations of Missouri, shall be paid to all workers performing work under the contract.
The contractor's bond shall include such provisions as will guarantee the faithful performance of
the prevailing hourly wage clause, as provided by the contract.
SECTION 6. This ordinance shall be in full force and effect
from and after its passage.
