Section 101-111 Ord. 16372; Rezoning Property Located on Both Sides of John Garry Drive from O-1 to C-P; Approving the C-P Development Plan of "Corporate Lake"

AN ORDINANCE

rezoning property located on the south side of Southampton Drive on both sides of John Garry Drive from District O-1 to District C-P; amending the Land Use Plan; repealing all conflicting ordinances or parts of ordinances; approving the C-P development plan of “Corporate Lake”; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.  The Zoning District Map established and adopted by Section 294 of the Code of Ordinances of the City of Columbia, Missouri, is amended so that the following property:
        
A tract of land located in the southwest 1/4 of Section 36, T48N, R13W, in Columbia, Boone County, Missouri being all of Lot 63 and a portion of Lot 64 of Corporate Lake, Plat 12 as recorded in Plat Book 30 at Page 68 of the Boone County records and being further described as follows:

Lot 63 of Corporate Lake, Plat 12 and a tract starting at the northeast corner of Lot 64 of Corporate Lake, Plat 12; thence N 88E21'00"W, 237.99 feet to the Point of Beginning; thence S 1E39'00"W, 205.0 feet; thence N 88E22'50"W, 359.88 feet to the west side of Lot 64; thence N 2E56'50"E, 12.50 feet; thence N 9E52'20"E, 141.03 feet; thence N 2E56'50"E, 24.54 feet; thence along a curve to the right having a radius of 30 feet for an arc length of 47.19 feet, said point lies N 48E00'40"E, 42.47 feet from the beginning of the curve; thence along a curve to the left having a radius of 2336.78 feet for an arc length of 58.15 feet, said point lies S 87E38'10"E, 58.15 feet from the previous point; thence S 88E21'00"E, 250.00 feet to the Point of Beginning.  Total area containing 4.46 acres.  Tract is subject to easements and restrictions of record.

will be rezoned and become a part of District C-P (Planned Business District) and taken away from District O-1 (Office District).  Hereafter the property may be used for all permitted uses in District C-1 (Intermediate Business District).

    SECTION 2.  The property described in Section 1 is designated "Planned Commercial" on the Land Use Plan.   

    SECTION 3.  All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.
    SECTION 4. The City Council hereby approves the “Corporate Lake” C-P development plan for the property referenced in Section 1 above.  The Director of Planning and Development shall use the design parameters set forth in “Exhibit A” which is attached to and made a part of this ordinance as guidance when considering any future revisions to the C-P Development Plan.

    SECTION 5.  This ordinance shall be in full force and effect from and after its passage.
