Section 101-116 Ord. 16377; Vacating Portions of a Street Right of Way and Easements within Plat No. 3 of Vanderveen Subdivision

AN ORDINANCE

vacating portions of a street right-of-way and easements; directing the City Clerk to have a copy of this ordinance recorded; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.  The City Council finds and determines that portions of street right of way located within Plat No. 3 of Vanderveen Subdivision, more particularly described as follows:

All of the right-of-way of Kangaroo Court as shown by the final plat of Vanderveen Crossing, Plat No. 3 as recorded in Plat Book 33 at Page 88 of the Boone County records.
                
are in excess and surplus to the needs of the City and are hereby vacated.

    SECTION 2.  The City Council finds and determines that certain easements located within Plat No. 3 of Vanderveen Subdivision, more particularly described as follows:

All of the drainage easements, utility easements, and sanitary sewer easements within the limits of Lots 176 through 181 of Vanderveen Crossing, Plat No. 3 as recorded in Plat Book 33 at Page 88 of the Boone County records as dedicated by said plat, and that portion of the sanitary sewer easement recorded in Book 792 at Page 401 of said County records which lies within the limits of Lots 178, 179, and 180 of said Vanderveen Crossing, Plat No. 3.

AND

Small strips of land located in the northeast quarter of Section 36, Township 49 North, Range 13 West in Columbia, Boone County, Missouri and being further described as follows:

All of the easement for sanitary sewer recorded in Book 795 at Page 754 of the Boone County records and,

A portion of the sanitary sewer easements shown by the final plat of Dinwiddie Industrial Park, Plat No. 1 as recorded in Plat Book 21 at Page 58 of said county records and being further described as follows:

A strip of land 16 feet in width being the southwesterly 16 feet of Lot 8 of said Dinwiddie Industrial Park, Plat No. 1 and any easement retained within the right-of-way of Dinwiddie Circle as shown by same plat and,
A strip of land 16 feet in width being the south-southeasterly 16 feet of Lot 9 of said Dinwiddie Industrial Park, Plat No. 1 and,
A strip of land 16 feet in width being the south-southeasterly 16 feet of Lot 10 of said Dinwiddie Industrial Park, Plat No. 1 and,
A strip of land 16 feet in width being the south-southeasterly 16 feet of Lot 11 of said Dinwiddie Industrial Park, Plat No. 1.
 
are in excess and surplus to the needs of the City and are hereby vacated.

    SECTION 3.  The City Clerk is hereby authorized and directed to cause a copy of this ordinance to be recorded in the office of the Recorder of Deeds of Boone County, Missouri.

    SECTION 4. This ordinance shall be in full force and effect from and after its passage.
