AN ORDINANCE

rezoning property located on the south side of Clark Lane, across from Ballenger Place from Districts R-2 and O-P to District C-P and from District A-1 to District O-P; amending the land use plan; repealing all conflicting ordinances or parts of ordinances; and fixing the time when this ordinance shall become effective.

    SECTION 1.  The Zoning District Map established and adopted by Section 294 of the Code of Ordinances of the City of Columbia, Missouri, is amended so that the following property:

A TRACT LOCATED IN SECTION 9, TOWNSHIP 48 NORTH, RANGE 12 WEST, BOONE COUNTY, MISSOURI, CITY OF COLUMBIA, AND BEING PART OF THE TRACT DESCRIBED BY THE DEED IN BOOK 1127 PAGE 315 OF THE BOONE COUNTY RECORDS BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:

STARTING AT THE NORTH EAST CORNER OF SAID SECTION 9; THENCE WITH THE LINES OF THE TRACT DESCRIBED BY SAID DEED IN BOOK 1127 PAGE 315 S 00°49'30" E, 260.00 FEET; THENCE S 34°08'30" W, 194.70 FEET; THENCE S 12°47'30" W, 118.20 FEET; THENCE S 43°52'30"W, 318.65 FEET; THENCE S 08°39'30" W, 166.70 FEET; THENCE N 89°00'30"W, 303.80 FEET TO THE POINT OF BEGINNING.

THENCE FROM THE POINT OF BEGINNING CONTINUING WITH SAID LINES N 89°00'30"W, 186.20 FEET; THENCE N 58°02'30" W, 116.60 FEET; THENCE N 89°00'30"W, 204.00 FEET; THENCE LEAVING THE LINES OF THE TRACT DESCRIBED BY SAID DEED IN BOOK 1127 PAGE 315, N 01°19'15" W, 443.35 FEET; THENCE S 89°19'30" W, 8.00 FEET; THENCE N 01°19'30"W, 160.00 FEET; THENCE S 89°19'30"W, 120.00 FEET TO A POINT ON THE WEST OF LINE OF THE TRACT DESCRIBED BY SAID DEED IN BOOK 1127 PAGE 315; THENCE WITH SAID WEST LINE N 01°19'15" W, 173.75 FEET; THENCE WITH THE NORTH LINE OF THE TRACT DESCRIBED BY SAID DEED IN BOOK 1127 PAGE 315, WITH A NON TANGENT CURVE TO THE LEFT 233.50 FEET, CURVE RADIUS 469.26 FEET, CHORD N 72°40'30" E, 231.10 FEET, THENCE N 89°19'30"E, 514.60; THENCE S 06°13'30"W, 924.25 FEET TO THE POINT OF BEGINNING AND CONTAINS 11.63 ACRES.

will be rezoned and become a part of District C-P and taken away from Districts R-2 and O-P. Hereafter the property may be used for all permitted uses in District C-3 except the uses listed on the attached Exhibit A.
    SECTION 2.  The property described in Section 1 is designated “Planned Commercial” on the Land Use Plan.

    SECTION 3.  The Zoning District Map established and adopted by Section 294 of the Code of Ordinances of the City of Columbia, Missouri, is amended so that the following property:

STARTING AT THE NORTHEAST CORNER OF SAID SECTION 9; THENCE WITH THE LINES OF THE TRACT DESCRIBED BY SAID DEED IN BOOK 1127 PAGE 315 S00°49'30"E, 260.00 FEET; THENCE S34°08'30"W, 194.70 FEET; THENCE S12°47'30"W, 118.20 FEET; THENCE S43°52'30"W, 318.65 FEET; THENCE S08°39'30"W, 166.70 FEET; THENCE N89°00'30"W, 303.80 FEET; THENCE LEAVING THE LINES OF THE TRACT DESCRIBED BY SAID DEED IN BOOK 1127 PAGE 315 N06°13'30"E, 295.10 FEET TO THE POINT OF BEGINNING.

THENCE FROM THE POINT OF BEGINNING N06°13'30"E, 226.25 FEET; THENCE N89°19'30E, 241.05 FEET; THENCE S49°23'00"W, 349.80 FEET TO THE POINT OF BEGINNING AND CONTAINS 0.62 ACRES.

will be rezoned and become a part of District O-P and taken away from District A-1. Hereafter the property may be used for all permitted uses in District O-1.

     SECTION 4.  The property described in Section 3 is designated “Planned Office” on the Land Use Plan.

    SECTION 5.  All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

    SECTION 6.  This ordinance shall be in full force and effect from and after its passage.

NOTE:  This ordinance was referred back to the Planning and Zoning Commission at the Council Meeting on 03/20/00 because substantive changes were made to the original rezoning request.
