Section 101-239 Ord. 16441; Construction of Wells 13 and 14 and Related Improvements in the McBaine Bottoms

determining that it is in the public interest to proceed with construction of wells 13 and 14 and related improvements in the McBaine Bottoms; determining that the work shall be done by contract; calling for bids through the Purchasing Division; appropriating funds; providing for payment for the improvement; providing for compliance with the prevailing wage law; and fixing the time when this ordinance shall become effective.


    SECTION 1.  Subsequent to the adoption of a resolution on May 1, 2000 and pursuant to publication of the resolution in a daily newspaper of general circulation in the City, and the affidavit of publication filed, and after a public hearing as provided for in Section 75 of the Home Rule Charter, the Council finds that the construction of wells 13 and 14 and related improvements in the McBaine Bottoms, including construction of approximately 2,200 feet of 18- inch ductile iron pipe, is necessary for the welfare and improvement of the City; that it is in the public interest such improvement be made; and that the Council hereby determines to proceed with the construction of the improvement.

    SECTION 2.  The construction of the improvement shall be done by contract.

    SECTION 3.  The City Manager, through the head of the Purchasing Division, is hereby authorized to call for bids for such improvements.

    SECTION 4.  The sum of $ 540,000.00 is hereby appropriated from the Water Bond Contingency Fund Account No. 550-7220-881.68-60 #WT0009 to the New Wells 13 & 14 Account No. 550-7120-610.49-90 #WT0101.

    SECTION 5.  Payment for this improvement shall be made from water system improvement bond issue funds, and such other funds as may be lawfully appropriated.

    SECTION 6.  The City shall cause to be inserted into the contract a stipulation to the effect that not less than the prevailing hourly rate of wages, as found by the Department of Labor and Industrial Relations of Missouri, shall be paid to all workers performing work under the contract. The contractor's bond shall include such provisions as will guarantee the faithful performance of the prevailing hourly wage clause, as provided by the contract.

    SECTION 7.  This ordinance shall be in full force and effect from and after its passage.
