Section 101-247 Ord. 16449; Construction of Improvements to the MKT Trail Access at Providence and Stewart Roads; Calling for Bids

declaring it is in the public interest to proceed with construction of improvements to the MKT Trail access at Providence Road and Stewart Road; approving plans and specifications for the improvements; calling for bids through the Purchasing Division; determining that a portion of the project shall be done by city employees;  providing for payment for the improvement; providing for compliance with the prevailing wage law; and fixing the time when this ordinance shall become effective.


    SECTION 1.  Subsequent to the adoption of a resolution by the City Council, declaring the necessity for construction of improvements to the MKT Trail access at Providence Road and Stewart Road and pursuant to the publication of the resolution in a daily newspaper of general circulation in the City of Columbia, Missouri, and the affidavit of publication filed; and after a public hearing as provided for in Section 75 of the Home Rule Charter, the Council finds and determines that construction of such improvements, including the addition of two bench sites, sidewalk improvements, signage and landscape improvements, is necessary for the welfare and improvement of the city and that it is in the public interest that such improvements be made.

    SECTION 2.  The plans and specifications for these improvements filed in the office of the city clerk, are hereby approved, adopted and made a part hereof by reference as fully as if set forth herein verbatim.

    SECTION 3.  The City Manager, through the head of the purchasing division, is hereby authorized to call for bids for a portion of the landscaping improvements.  The City Manager is hereby authorized to execute a contract for this improvement.  As deemed advisable by the City Manager pursuant to Section 70 of the City Charter, city employees shall be used for the installation of the benches, construction of sidewalk improvements and signage and landscape improvements.

    SECTION 4. Payment for this improvement shall be made from the Public Improvement Fund, and such other funds as may be lawfully appropriated.

    SECTION 5.  The City shall cause to be inserted into the contract a stipulation to the effect that not less than the prevailing hourly rate of wages, as found by the Department of Labor and Industrial Relations of Missouri, shall be paid to all workers performing work under the contract. The contractor's bond shall include such provisions as will guarantee the faithful performance of the prevailing hourly wage clause, as provided by the contract.

    SECTION 6.  This ordinance shall be in full force and effect from and after its passage.
