AN ORDINANCE

rezoning property located within the Benton Stephens Neighborhood from Districts R-3 and R-2 to Districts R-1 and R-2; repealing all conflicting ordinances or parts of ordinances; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.  The Zoning District Map established and adopted by Section 294 of the Code of Ordinances of the City of Columbia, Missouri, is amended so that the following property:

    Powers/Myrick  - 211 Ripley Street

The North Thirty-six and one-half (36 ½) feet of the South Seventy-Three (73) feet of Lot Number Sixteen AND the North Thirty-six and one-half (36 ½) feet of the South Seventy Three (73) feet of Lot Number Seventeen (17), All in R.B. Price’s Subdivision of the South part of Lot Number Four (4) of Stephens Addition to Columbia, Boone County, Missouri, as shown on the Plat of said Subdivision which is recorded in Book Number 87, Page 123, Boone County Missouri Records.

    Nunley - 1408 Pratt Street

A tract of land described in the Warranty Deed in Book 275 at page 315; said tract being Lot 26 of the Amended Plat of Edgewood Place as recorded in Plat Book 2 at page 47, both of the Boone County Records; situate in the City of Columbia, Boone County, Missouri.

    Hardy/Tegerdine - 1607 Hinkson Avenue

The West half of the West half of the South half of Lot Ten (10) of Stephen’s Addition to the City of Columbia, Missouri.

    Ellis/Yocum - 1409 Court Street

    Part of Lots Three (3) and Four (4) of Nowell’s Subdivision of Machir Place and Survey Number 3311, in the City of Columbia, Missouri, more accurately described as follows: Beginning at an iron post on the East property line of Court Street which is South 50 degrees East 53 ½ feet, from the Northwest corner of said Lot Three (3) in Nowell’s Subdivision; thence North 53 Degrees East 132 ½ feet, by estimation, to an iron post; thence South 33 degrees East 47 ½ feet to an iron post; thence South 53 degrees West 119 feet by estimation to an iron post; thence  North 50 degrees West 47 ½ feet to the Point of Beginning and shown as Lot Number Two (2) in the City Survey No. 100 Page 118.

    Lot Two (2) of CUNNINGHAM PLACE as shown by plat recorded in Plat Book 3, page 40, Boone County Records.

    Rogers - 504 N. William Street

    Part of the South half (S ½) of Lot Nine (9) in Stephen’s First Addition to the City of Columbia, Boone County, Missouri, described as follows: Beginning at a point 124.5 feet North of the Northeast Corner of Hinkson Avenue and Williams Street; thence East 115 feet; thence North 50 feet; thence West 115 feet; thence South 50 feet to the point of beginning.

    Thorpe/Keele - 1407 Court Street

    All of the North part of Lot Number 3 and all of the Northwest part of Lot Number 4 in Nowell’s Subdivision of Machir Place and Survey Number 3311, in the City of Columbia, Missouri, according to the recorded plat thereof, more particularly described as follows: Beginning at an iron post, the Northwest Corner of Lot Number 3 in said subdivision; thence North 53 degrees East a distance of 146.2 feet to an iron post; thence South 33 degrees east a distance of 35.5 feet to an iron post thence; South 53 degrees West to an iron post on the property line of Court Street; thence North 50 degrees West a distance of 53.5 feet to the point of beginning, shown as Lot Number 1 in City Survey Number 100, page 118.

    Lot Two (2) of J.H. McHarg’s Subdivision of Lot Ten (10) in the Subdivision of Lot Twenty-Seven (27) and a part of Lot Thirty (30) in the Stephens Second Addition to the town now City of Columbia, Boone County, Missouri except tract given to Mid-Missouri Barrier Free Housing for the Physically Handicapped, a Missouri Not-For-Profit Corporation in Warranty Deed Book 483, Page 448 of the Boone County Records.

    The South 105 feet of the East 36.7 feet of Lot No. Nine (9) in R.B. Price’s Subdivision on the South part of Lot No. Four (4), in Stephens Addition to Columbia, Missouri, and a part of the Southwest fractional quarter of Section 7, Township 48, Range 12, in Columbia, Missouri.

    Hume - 407 Melbourne Street

    The South half of a part of Lot Number 32 in R.B. Price’s Subdivision of the South part of Lot Number 4 in Stephen’s First Addition to Columbia, Missouri, and a part of the Southwest quarter of Section 7, Township 48 North, Range 12 West, in Boone County, Missouri, described as follows: commencing at the intersection of the South line of Hinkson Avenue and the West line of Melbourne Street (formerly Henderson Avenue); thence South along the West line of Melbourne Street 170 feet, to the point of beginning; thence South 95 feet along the West line of Melbourne Street; thence West 120 feet; thence North 98 feet; thence East 120 feet to the Point of Beginning.

Also, a part of Lot 32 in R.B. Price’s Subdivision of the South part of Lot Number 4 in Stephen’s First Addition to Columbia, and a part of the Southwest quarter of Section 7, Township 48 North, Range 12 West, in Boone County, Missouri, described as follows: beginning at the Northeast corner of Lot 31, in said addition, said point being 228.9 feet from the East line of Price Avenue; thence East with the continuation of the North line of Lot 31 a distance of 56.6 feet; thence North parallel to the East line of Price Avenue 50 feet; thence West 56.6 feet parallel to the North line of said Lot 31 to an iron; thence South 50 feet to the beginning.

    All of Lot Nine (9), the East Twenty-five (25) feet of Lot Thirteen (13), and that part of Baker Street vacated lying between said Lot Nine (9) and Lot Thirteen (13), all in Nowell’s Subdivision of Machir Place and Survey No. 3311 in the City of Columbia, Boone County, Missouri.

will be rezoned and become a part of District R-1 (One-Family Dwelling District) and taken away from District R-3 (Medium Density Multiple-Family Dwelling District).

    SECTION 2.   The Zoning District Map established and adopted by Section 294 of the Code of Ordinances of the City of Columbia, Missouri, is amended so that the following property:

    Hume - 1500 Richardson Street

    The North half (N ½) of Lot Number Ten (10) and the North half (N ½) of the West Twelve (12) feet of Lot Number Eleven (11) all in the Subdivision of Lot Number Twenty-three (23) of Stephen’s Addition to the City of Columbia, Missouri.

will be rezoned and become a part of District R-1 (One-Family Dwelling District) and taken away from District R-2 (Two-Family Dwelling District).

    SECTION 3.  The Zoning District Map established and adopted by Section 294 of the Code of Ordinances of the City of Columbia, Missouri, is amended so that the following property:
        
    Crane - 616 Paris Court

The South Fifty (50) feet of Lot Twenty (20) in Paris Court, a Subdivision of a part of Lot Number Two (2) in Stephen’s First Addition to the City of Columbia, Missouri.

    Ruh - 307 Melbourne Street

Lot Number One (1) in Cunningham Place, an Addition to the City of Columbia, Boone County, Missouri.

    Crutcher/McGowan - 601 Paris Court

Lot Number Eleven (11) of Paris Court, a Subdivision of a Part of Lot Number Two (2) in Stephen’s First Addition to the City of Columbia, Boone County, Missouri as shown by the Plat recorded in Plat Book 3, Page 17, Records of Boone County, Missouri.

    Hume - 301 Melbourne Street

The South portion of the East One Hundred Seventy-four (174) feet of Lot Number Twenty-nine (29) of R.B. Price’s Subdivision of the South part of Lot Four (4) of Stephen’s Addition to Columbia, Missouri, and part of the Southwest Quarter (SW 1/4) of Section Seven (7), Township Forty-eight (48) North, Range Twelve (12) West, of the Fifth (5th) Principal Meridian, in Boone County, Missouri, described as follows: Beginning at the southeast corner of said Lot Twenty-nine (29); thence North with West side of the North extension of Melbourne Street, Fifty (50) feet; thence West parallel with the South line of said Lot One Hundred Seventy-four (174) feet; thence South parallel to the West line of Melbourne Street Fifty (50) feet to the South line of said lot; thence East along the South line of said Lot One Hundred Seventy-four (174) feet to the beginning.
    
will be rezoned and become a part of District R-2 (Two-Family Dwelling District) and taken away from District R-3 (Medium Density Multiple-Family Dwelling District).

    SECTION 4.  All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

    SECTION 5.  This ordinance shall be in full force and effect from and after its passage.
