AN ORDINANCE

vacating a sanitary sewer easement; directing the City Clerk to have a copy of this ordinance recorded; accepting conveyances for sewer purposes; directing the City Clerk to have the conveyances recorded; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.  The City Council finds and determines that a certain sanitary sewer easement over a part of Lot Two Hundred Three (203) of the Original Town, now City of Columbia, Boone County, Missouri, more particularly described as follows:

A SIXTEEN (16) FOOT SANITARY SEWER EASEMENT ACROSS LOT 203 OF THE ORIGINAL TOWN OF COLUMBIA, RECORDED IN BOOK A, PAGE 335 OF THE BOONE COUNTY RECORDS, THE CENTERLINE OF WHICH IS DESCRIBED AS FOLLOWS:

STARTING AT THE SOUTHWEST CORNER OF SAID LOT 203; THENCE EAST WITH THE SOUTH LINE OF SAID LOT 203, 12.45 FEET TO THE POINT OF BEGINNING OF THIS EASEMENT; THENCE FROM THE POINT OF BEGINNING N 1E36" W, 150.05 FEET TO THE CENTERLINE OF A 15 FOOT ALLEY VACATED BY THE CITY OF COLUMBIA AND RECORDED IN BOOK 326, PAGE 407, BEING 8.25 FEET EAST OF THE WEST LOT LINE OF SAID LOT 203, PROJECTED TO THE CENTERLINE OF SAID ALLEY, AND THE END OF THIS EASEMENT.

is in excess and surplus to the needs of the City and is hereby vacated.

    SECTION 2.  The City Clerk is hereby authorized and directed to cause a copy of this ordinance to be recorded in the office of the Recorder of Deeds of Boone County, Missouri.

    SECTION 3.  The conveyance to the City of Columbia, Missouri, a municipal corporation, more particularly described as follows:

Grant of Easement from Dan Hagan, dated May 9, 2000, more particularly described in Exhibit "A" attached hereto and made a part hereof as fully as if set forth herein verbatim.

is hereby accepted.

    SECTION 4.  The City Clerk is hereby authorized and directed to have the conveyance recorded in the office of the Boone County Recorder of Deeds.

    SECTION 5.  This ordinance shall be in full force and effect from and after its passage.
