Section 101-331 Ord. 16500; Amending Ordinance No. 012531 RE: Incorrectly Described Property; Authorizing Issuance of a New Taxbill

AN ORDINANCE

amending Ordinance No. 012531 by deleting language levying a special assessment against incorrectly described property; voiding the taxbill issued pursuant to that special assessment; levying a special assessment against the property originally intended to be assessed; authorizing issuance of a taxbill; and fixing the time when this ordinance shall become effective.

    WHEREAS, Ordinance No. 012531 enacted on March 5, 1990 accepted the work for improvements to North William Street and levied special assessments and authorized issuance of taxbills against property specially benefitted and abutting the improvement, and

    WHEREAS, it was discovered that the legal description of one of the tracts  is incorrect, and

    WHEREAS, the City Council wishes to correct this situation by deleting the incorrect description from Ordinance No. 012531, voiding the taxbill against that property, levying a special assessment against the property originally intended to be assessed and authorizing the issuance of a new taxbill against the property originally intended to be assessed.

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.  Section 6 of Ordinance No. 012531 is amended by deleting the language on page 2 of the ordinance that levied a special assessment in the amount of $1,131.90 “Against part of Lots 1 and 2 as described by warranty deed as recorded in Book 450, Page 420 of the Boone County, Missouri Records, and abutting 154 feet.”

    SECTION 2.  Special assessment Taxbill No. 12,945 which was issued against the property described in Section 1 of this ordinance, is hereby declared void.

    SECTION 3.  A special assessment in the amount of $1,131.90 ($7.35 x 154 abutting feet) is levied against the following described property which the City Council finds was specially benefitted by the public improvement of North William Street:  

Lots 1 and 2 of the Subdivision of Lot 23 of Stephen’s First Addition to the City of Columbia, Missouri as described in Warranty Deed recorded in Book 450, Page 420 of the Boone County, Missouri records.

    SECTION 4.  The City Clerk is hereby authorized and directed to issue a special assessment taxbill immediately against the property described in Section 3 which is hereby declared to have been specially benefitted in the amount assessed against it.  The taxbill shall be signed by the City Clerk under the corporate seal of the City.  The City Clerk shall register the taxbill in the office of the Director of Finance for collection. The special tax bills shall mature and shall be due and payable sixty days after date of issue. After the expiration of sixty days, the tax bills shall bear interest at the rate of nine percent (9%) per annum on the unpaid balance until paid.

    SECTION 5.  This ordinance shall be in full force and effect from and after its passage.
