Section 101-459 Ord. 16577; Voluntary Annexation of Property Located Generally North of State Route K and Southeast of Old Plank Road

extending the corporate limits of the City of Columbia, Missouri, by annexing property located generally north of State Route K and southeast of Old Plank Road; and fixing the time when this ordinance shall become effective.


    SECTION 1.  The City Council hereby finds that verified petitions were filed with the City requesting the annexation of land which is contiguous and compact to the existing corporate limits of the City and which is described in Section 4 of this ordinance.  These petitions were signed by the owners of the fee interest of record in the land proposed to be annexed or by the attorney-in-fact for such owners.  A public hearing was held concerning this matter on August 21, 2000.  Notice of this hearing was published more than seven days prior to the hearing in two newspapers of general circulation qualified to publish legal matters.  At the public hearing all interested persons, corporations and political subdivisions were permitted to present evidence regarding the proposed annexation.

    SECTION 2.  The Council determines that the annexation is reasonable and necessary to the proper development of the City and that the City has the ability to furnish normal municipal services to the area to be annexed within a reasonable time.

    SECTION 3.  The Council determines that no written objection to the proposed annexation has been filed within fourteen days after the public hearing.

    SECTION 4.  The City Council hereby extends the city limits by annexing the land described in Section 1-11.75 of the Code of Ordinances of the City of Columbia, Missouri, which is hereby added to Chapter 1 of the City Code and which reads as follows:

    Section 1-11.75.  September, 2000 Extension of Corporate Limits.

    The corporate limits of the City of Columbia shall include the following land:

A tract of land in the northwest 1/4 of Section 11, T47N, R13W, Boone County, Missouri.  All of Victoria South Plat 1, recorded in plat book 32, page 83 of the Boone County, Missouri records is contained within this tract.  Said tract is more particularly described as follows:

Beginning at the northwest corner of the northeast 1/4 of the northwest 1/4 of said section 11; thence S0E-00'-50"W, along the 1/4 1/4 section line, 513.90 feet; thence following the lines of the survey recorded in book 349, page 14: N89E-46'-00"E 765.15 feet,  S19E-04'-00"E 282.00 feet, S2E-30'-00"W 308.90 feet, S89E-26'-50"W 849.65 feet; thence leaving the lines of said survey, S0E-22'-50"E 179.40 feet to the north right-of-way line of State Route “K”; thence following said north right-of-way line, along a 1115.80 foot radius curve to the right 249.74 feet (chord = N74E-10'-55"W 249.20 feet); thence leaving said north right-of-line, N20E-56'-50"E 80.00 feet; thence N11E-19'-50"E 38.40 feet; thence N2E-38'-00"E 180.00 feet; thence N80E-16'-00"W 175.00 feet to the west line of tract 1 of the survey recorded in book 279, page 382; thence N1E-28'-00"E, along said west line of tract 1, 883.05 feet to the north line of said section; thence N89E-49'-30"E, along said section line, 350.00 feet to the point of beginning and containing 20.18 acres.

    SECTION 5.  The City Clerk is hereby authorized and directed to cause three certified copies of this ordinance to be filed with the Clerk of Boone County, Missouri.

    SECTION 6.  The property described in Section 4 is in the Fifth Ward.

    SECTION 7.  This ordinance shall be in full force and effect from and after its passage.
