AN ORDINANCE

rezoning property located on the south side of Clark Lane, east of Crump Lane from Districts A-1, R-2 and O-P to Districts C-P and O-P; amending the land use plan; repealing all conflicting ordinances or parts of ordinances; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.  The Zoning District Map established and adopted by Section 294 of the Code of Ordinances of the City of Columbia, Missouri, is amended so that the following property:

A TRACT LOCATED IN SECTION 9, TOWNSHIP 48 NORTH, RANGE 12 WEST, BOONE COUNTY, MISSOURI, CITY OF COLUMBIA, AND BEING PART OF THE TRACT DESCRIBED BY THE DEED IN BOOK 1127 PAGE 315 OF THE BOONE COUNTY RECORDS BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS;

STARTING AT THE NORTH EAST CORNER OF SAID SECTION 9; THENCE WITH THE LINES OF THE TRACT DESCRIBED BY SAID DEED IN BOOK 1127 PAGE 315  S 00E 49' 30" E, 260.00 FEET; THENCE S 34E 08' 30" W, 194.70 FEET; THENCE S 12E 47' 30"  W, 118.20 FEET; THENCE S 43E 52' 30" W, 318.65 FEET; THENCE S 08E 39' 30" W, 166.70 FEET; THENCE N 89E 00' 30" W, 303.80 FEET TO THE POINT OF BEGINNING; THENCE FROM THE POINT OF BEGINNING CONTINUING WITH SAID LINES N 89E 00' 30" W, 186.20 FEET; THENCE N 58E 02' 30" W, 116.60 FEET; THENCE N 89E 00' 30" W, 204.00 FEET; THENCE LEAVING THE LINES OF THE TRACT DESCRIBED BY SAID DEED IN BOOK 1127 PAGE 315; N 01E 19' 15" W, 443.35 FEET; THENCE S 89E 19' 30" W, 8.00 FEET; THENCE N 01E 19' 30" W, 160.00 FEET; THENCE S 89E 19' 30" W, 120.00 FEET TO A POINT ON THE WEST OF LINE OF THE TRACT DESCRIBED BY SAID DEED IN BOOK 1127 PAGE 315; THENCE WITH SAID WEST LINE N 01E 19' 15" W, 173.75 FEET; THENCE WITH THE NORTH LINE OF THE TRACT DESCRIBED BY SAID DEED IN BOOK 1127 PAGE 315; WITH A NON TANGENT CURVE TO THE LEFT 233.50 FEET, CURVE RADIUS 469.26 FEET, CHORD N 72E 40' 30" E, 231.10 FEET; THENCE N 89E 19' 30" E, 514.60; THENCE S 06E 13' 30" W, 924.25 FEET TO THE POINT OF BEGINNING AND CONTAINS 11.63 ACRES

will be rezoned and become a part of District C-P (Planned Business District) and taken away from Districts R-2 (Two-Family Dwelling District) and O-P (Planned Office District).  Hereafter the property may be used for all the permitted uses in District C-3 except the uses listed in “Exhibit A” which is attached to and made a part of this ordinance.

    SECTION 2.  The property described in Section 1 is designated “Planned Commercial” on the Land Use Plan.

    SECTION 3.  The Zoning District Map established and adopted by Section 294 of the Code of Ordinances of the City of Columbia, Missouri, is amended so that the following property:

STARTING AT THE NORTH EAST CORNER OF SAID SECTION 9; THENCE WITH THE LINES OF THE TRACT DESCRIBED BY SAID DEED IN BOOK 1127 PAGE 315 S 00E 49' 30" E, 260.00 FEET; THENCE S 34E08' 30" W, 194.70 FEET; THENCE S 12E 47' 30" W, 118.20 FEET; THENCE S 43E 52' 30" W, 318.65 FEET; THENCE S 08E 39' 30" W, 166.70 FEET; THENCE N 89E 00' 30" W, 303.80 FEET; THENCE LEAVING THE LINES OF THE TRACT DESCRIBED BY SAID DEED IN BOOK 1127 PAGE 315 N 06E 13' 30" E, 295.10 FEET TO THE POINT OF BEGINNING; THENCE FROM THE POINT OF BEGINNING N 06E 13' 30" E, 226.25 FEET; THENCE N 89E 19' 30" E, 241.05 FEET; THENCE S 49E 23' 00" W, 349.80 FEET TO THE POINT OF BEGINNING AND CONTAINS 0.62 ACRES.

will be rezoned and become a part of District O-P (Planned Office District) and taken away from District A-1 (Agricultural District).  Hereafter the property may be used for all the uses listed in “Exhibit B” which is attached to and made a part of this ordinance.

    SECTION 4.  All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

    SECTION 5.  This ordinance shall be in full force and effect from and after its passage.
