AN ORDINANCE

rezoning property located on the north side of Brown School Road, west of Roger I Wilson Memorial Drive from District R-1 to Districts C-P and C-3; amending the land use plan; repealing all conflicting ordinances or parts of ordinances; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.  The Zoning District Map established and adopted by Section 294 of the Code of Ordinances of the City of Columbia, Missouri, is amended so that the following property:

A TRACT OF LAND LOCATED IN THE EAST HALF OF SECTION 30, TOWNSHIP 49 NORTH, RANGE 12 WEST, COLUMBIA, BOONE COUNTY, MISSOURI, BEING PART OF THE TRACT SHOWN BY THE SURVEY RECORDED IN BOOK 1123, PAGE 121 AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:

BEGINNING AT THE SOUTHEAST CORNER OF LOT 2, ARCADIA PLAT 2, RECORDED IN PLAT BOOK 30, PAGE 2, SAID CORNER BEING ON THE NORTH LINE OF THE TRACT DESCRIBED BY THE EASEMENT FOR STREET PURPOSES RECORDED IN BOOK 1223, PAGE 175; THENCE S4°11'20"E, 191.56 FEET TO THE NORTH RIGHT-OF-WAY LINE OF BROWN SCHOOL ROAD AS SHOWN BY ARCADIA PLAT 6, RECORDED IN PLAT BOOK 34, PAGE 26; THENCE WITH SAID NORTH LINE, 463.66 FEET ALONG A 746.96-FOOT RADIUS NON-TANGENT CURVE TO THE RIGHT, SAID CURVE HAVING A CHORD N66°20'10"W, 456.25 FEET; THENCE N48°33'15"W, 300.95 FEET TO THE NORTH LINE OF SAID TRACT DESCRIBED BY BOOK 1223, PAGE 175 AND THE SOUTH LINE OF SAID LOT 2, ARCADIA PLAT 2; THENCE LEAVING THE NORTH LINE OF BROWN SCHOOL ROAD AND WITH THE SOUTH LINE OF SAID LOT 2, 483.07 FEET ALONG A 725.00-FOOT RADIUS NON-TANGENT CURVE TO THE LEFT, SAID CURVE HAVING A CHORD, S67°38'35"E, 474.18 FEET; THENCE S86°43'50"E, 191.25 FEET TO THE POINT OF BEGINNING AND CONTAINING 1.45 ACRES.


will be rezoned and become a part of District C-P (Planned Business District) and taken away from District R-1 (One-Family Dwelling District).  Hereafter the property may be used for all the permitted uses in District C-1 and commercial athletic fields.

    SECTION 2.  The property described in Section 1 is designated “Planned Commercial” on the Land Use Plan.

    SECTION 3.  The Zoning District Map established and adopted by Section 294 of the Code of Ordinances of the City of Columbia, Missouri, is amended so that the following property:

A TRACT OF LAND LOCATED IN THE EAST HALF OF SECTION 30, TOWNSHIP 49 NORTH, RANGE 12 WEST, COLUMBIA, BOONE COUNTY, MISSOURI, BEING PART OF THE TRACT SHOWN BY THE SURVEY RECORDED IN BOOK 1123, PAGE 121 AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:

BEGINNING AT THE SOUTHEAST CORNER OF LOT 2, ARCADIA PLAT 2, RECORDED IN PLAT BOOK 30, PAGE 2, SAID CORNER BEING ON THE NORTH LINE OF THE TRACT DESCRIBED BY THE EASEMENT FOR STREET PURPOSES RECORDED IN BOOK 1223, PAGE 175; THENCE WITH SAID NORTH LINE, S86°43'50"E, 135.92 FEET; THENCE LEAVING SAID NORTH LINE S3°16'10"W, 66.00 FEET; THENCE S21°29'30"E, 124.90 FEET TO THE NORTHEAST CORNER OF BROWN SCHOOL ROAD RIGHT-OF-WAY AS SHOWN BY ARCADIA PLAT 6, RECORDED IN PLAT BOOK 34, PAGE 26; THENCE WITH THE NORTH LINE OF SAID BROWN SCHOOL ROAD, 164.06 FEET ALONG 746.96-FOOT RADIUS NON-TANGENT CURVE TO THE RIGHT, SAID CURVE  HAVING A CHORD S89°35'20"W, 163.73 FEET; THENCE LEAVING SAID NORTH LINE, N4°11'20"W, 191.56 FEET TO THE POINT OF BEGINNING AND CONTAINING 0.61 ACRES.

will be rezoned and become a part of District C-3 (General Business District) and taken away from District R-1 (One-Family Dwelling District).

    SECTION 4.  The property described in Section 3 is designated “Commercial” on the Land Use Plan.

    SECTION 5.  All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

    SECTION 6.  This ordinance shall be in full force and effect from and after its passage.
