AN ORDINANCE

rezoning property located on the north side of Vawter School Road, approximately 1,000 feet east of Scott’s Boulevard from District C-P to District R-1; amending the land use plan; repealing all conflicting ordinances or parts of ordinances; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.  The Zoning District Map established and adopted by Section 294 of the Code of Ordinances of the City of Columbia, Missouri, is amended so that the following property:

A TRACT OF LAND LOCATED IN THE SOUTHWEST QUARTER OF SECTION 28, TOWNSHIP 48 NORTH, RANGE 13 WEST, COLUMBIA, BOONE COUNTY, MISSOURI, BEING PART OF THE TRACT DESCRIBED BY THE TRUSTEE’S DEED RECORDED IN BOOK 1572, PAGE 728 AND PART OF THE SURVEY RECORDED IN BOOK 1571, PAGE 291 AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:

COMMENCING AT THE SOUTHWEST CORNER OF SECTION 28-48-13; THENCE WITH THE SECTION LINE, S84E30'55"E, 574.30 FEET TO THE CENTERLINE OF VAWTER SCHOOL ROAD AS DESCRIBED BY THE EASEMENT FOR ROADWAY AND UTILITY PURPOSES RECORDED IN BOOK 1329, PAGE 283; THENCE LEAVING SAID SECTION LINE AND WITH SAID CENTERLINE, 304.70 FEET ALONG AN 11,837.72-FOOT RADIUS CURVE TO THE LEFT, SAID CURVE HAVING A CHORD, S85E15'10"E, 304.69 FEET; THENCE LEAVING SAID CENTERLINE, N4E00'35"E, 33.00 FEET TO THE NORTH LINE OF SAID EASEMENT, THE POINT OF BEGINNING;

THENCE FROM THE POINT OF BEGINNING, LEAVING SAID NORTH LINE, N3E04'00"E, 811.28 FEET TO THE CENTERLINE OF HINKSON CREEK AND THE NORTH LINE OF THE SURVEY RECORDED IN BOOK 1571, PAGE 291; THENCE WITH SAID CENTERLINE AND SAID NORTH LINE, S59E21'00"E, 48.00 FEET; THENCE S77E31'00"E, 37.90 FEET; THENCE LEAVING SAID CENTERLINE AND SAID NORTH LINE S0E03'10"E.  785.40 FEET TO THE NORTH LINE OF SAID VAWTER SCHOOL ROAD; THENCE WITH SAID NORTH LINE, 122.69 FEET ALONG AN 11,804.72-FOOT RADIUS NON-TANGENT CURVE TO THE RIGHT, SAID CURVE HAVING A CHORD, N86E17'15"W, 122.69 FEET TO THE POINT OF BEGINNING AND CONTAINING 1.84 ACRES.        

will be rezoned and become a part of District R-1 (One-Family Dwelling District) and taken away from District C-P (Planned Business District).

    SECTION 2.  The property described in Section 1 is designated “Low-Density Residential” on the Land Use Plan.

    SECTION 3.  All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

    SECTION 4.  This ordinance shall be in full force and effect from and after its passage.
