Section 101-597 Ord. 16660; Approving Final Plat of Smithton Park; Granting Variances to Subdivision Regulations RE: Sewer Line Extension and Cul-de-sac Construction; Authorizing a Performance Contract

AN ORDINANCE

approving the Final Plat of Smithton Park, a minor subdivision; accepting the dedication of rightsofway and easements; granting variances to the Subdivision Regulations; authorizing a performance contract; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.  The City Council hereby approves the Final Plat of Smithton Park, dated October 11, 2000, a minor subdivision located on the northeast corner of Silvey Street and West Worley Street, containing approximately 12.19 acres in the City of Columbia, Boone County, Missouri, and hereby authorizes and directs the Mayor and City Clerk to sign the plat evidencing such approval.

    SECTION 2.  The City Council hereby accepts the dedication of all rightsofway and easements as dedicated upon the plat.

    SECTION 3.  Subdivider is granted a variance from the requirements of Section 25-56 of the Subdivision Regulations so that sewer lines shall not be required to extend to each lot.

    SECTION 4.  Subdivider is granted a variance from the requirements of Section 25-47(b) of the Subdivision Regulations so that a cul-de-sac bulb shall not be required to be constructed at the eastern terminus of Burbon Street.

    SECTION 5.  The City Manager is hereby authorized to execute a performance contract with Evangelical Free Church of Columbia, Inc. in connection with the approval of the Final Plat of Smithton Park.  The form and content of the contract shall be substantially as set forth in "Exhibit A" attached hereto and made a part hereof as fully as if set forth herein verbatim.

    SECTION 6.  This ordinance shall be in full force and effect from and after its passage.
