rightsofway and easements; authorizing a cost sharing agreement with LOTE Development, Inc.;
authorizing a performance contract; and fixing the time when this ordinance shall become
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS
SECTION 1. The City Council hereby approves the Final
Plat of R.T.W. Addition, dated
August 28, 2000, a major subdivision located on the west side of Ballenger Lane, across from
Aztec Boulevard, containing approximately 5.91 acres in the City of Columbia, Boone County,
Missouri, and hereby authorizes and directs the Mayor and City Clerk to sign the plat evidencing
SECTION 2. The City Council hereby accepts the dedication
of all rightsofway and
easements as dedicated upon the plat.
SECTION 3. The City Manager is hereby authorized to execute
a cost sharing agreement with
LOTE Development, Inc. pertaining to the reconstruction of Ballenger Lane. The form and
content of the contract shall be substantially as set forth in "Exhibit A" attached hereto
a part hereof as fully as if set forth herein verbatim. The approval of the Final Plat of R.T.W.
Addition is subject to the condition that subdivider, LOTE Development, Inc., enter into this
agreement with the City. This condition shall be satisfied upon execution of the agreement and
shall not be affected by a disapproval of the Ballenger Lane project by the Missouri Department
of Transportation or by a determination of the City Council, following a public hearing, not to
proceed with the project.
SECTION 4. The City Manager is hereby authorized to execute
a performance contract with
LOTE Development, Inc. in connection with the approval of the Final Plat of R.T.W. Addition.
The form and content of the contract shall be substantially as set forth in "Exhibit B"
hereto and made a part hereof as fully as if set forth herein verbatim.
SECTION 5. This ordinance shall be in full force and effect
from and after its passage.
