Section 101-647 Ord. 16698; Approving the PUD Development Site Plan of Westbury Village

AN ORDINANCE

approving the Planned Unit Development Site Plan of Westbury Village; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    Section 1.  The City Council hereby approves the Planned Unit Development Site Plan of Westbury Village, dated October 30, 2000, located between Scott Boulevard and Stone Valley Parkway, north of Smith Drive.

    SECTION 2. The approval of the Planned Unit Development Site Plan of Westbury Village is subject to the following conditions which have been agreed to by the property owner:

1.    The developer shall enter into an agreement with the City, prior to any final plat approval, whereby the developer agrees to construct or pay for construction of certain traffic improvements which will be needed for the entire mixed-use development.  The agreement will need to phase the timing of the improvements, some of which will be required in conjunction with development of the PUD.

2.    Dayspring Drive shall be constructed as part of Phase 2 of the PUD.

3.    The PUD shall be subject to the provisions outlined in the October 27 letter from Richard M. Kniss, AIA, regarding the “Residential Development Guidelines.”  A copy of this letter, marked “Exhibit A,” is attached to this ordinance.”

4.    Traffic calming devices shall be installed on Dayspring Drive that are designed to reduce traffic speed to 15 m.p.h.

5.    The property owner shall record covenants for Westbury Village that prohibit parking motor vehicles over any part of a sidewalk or other walkway.

    SECTION 3.  This ordinance shall be in full force and effect from and after its passage.
