Section 101-674 Ord. 16718; Approving the Final Plat of Bearfield Meadows; Approving a Development Agreement; Authorizing a Performance Contract

AN ORDINANCE

approving the Final Plat of Bearfield Meadows, a major subdivision; accepting the dedication of rightsofway and easements; conditioning approval on execution of a development agreement and directing the City Clerk to have the agreement recorded; authorizing a performance contract; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.  Subject to the condition set forth in Section 3, the City Council hereby approves the Final Plat of Bearfield Meadows, dated October 5, 2000, a major subdivision located on the west side of Bearfield Road, approximately 500 feet south of Nifong Boulevard, containing approximately 35.41 acres in the City of Columbia, Boone County, Missouri, and hereby authorizes and directs the Mayor and City Clerk to sign the plat evidencing such approval after the Bearfield Meadows Development Agreement referenced in Section 3 has been executed.

    SECTION 2.  The City Council hereby accepts the dedication of all rightsofway and easements as dedicated upon the plat.

    SECTION 3.  The approval of the Final Plat of Bearfield Meadows is subject to the condition that property owner enter into the Bearfield Meadows Development Agreement with the City, a copy of which, marked “Exhibit A” is attached to and made a part of this ordinance. The City Manager is authorized to execute the Bearfield Meadows Development Agreement on behalf of the City.  The City Manager is further authorized to accept and convey development rights on behalf of the City pursuant to the Bearfield Meadows Development Agreement.  The City Clerk is authorized and directed to have the Bearfield Meadows Development Agreement recorded in the office of the Boone County Recorder of Deeds and to record the development rights conveyed to the City pursuant to the Bearfield Meadows Development Agreement.  Any covenants recorded for Bearfield Meadows that are consistent with the provisions of the Bearfield Meadows Development Agreement and the ordinances of the City are acceptable to the City.

    SECTION 4.  The City Manager is hereby authorized to execute a performance contract with Lifestyle Homes, Inc. in connection with the approval of the Final Plat of Bearfield Meadows. The form and content of the contract shall be substantially as set forth in "Exhibit B" attached hereto and made a part hereof as fully as if set forth herein verbatim.

    SECTION 5.  This ordinance shall be in full force and effect from and after its passage.
