AN ORDINANCE

approving an amendment to the Broadway Farms Business Park OP Development Plan; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

SECTION 1. The City Council hereby approves an amendment to the Broadway Farms Business Park OP Development Plan, dated October 26, 2000, for property located on the southwest corner of West Broadway and Fairview Road to allow for construction of a driveway through the site connecting Fairview Road with the new Hy-Vee grocery store’s parking lot.

SECTION 2. The construction of the drive onto Fairview Road shall be contingent upon an agreement between the City and the Developer to include traffic calming and other devices on Kunlun Drive and Broadfield Road. Developer shall pay half the cost of these improvements with a cap not to exceed $15,000.

SECTION 3. This ordinance shall be in full force and effect from and after its passage.
