Section 102-036 Ord. 16748; Vacating a Portion of a Water Utility Easement Located on the Boone Retirement Center Property

vacating a portion of a water utility easement; directing the City Clerk to have a copy of this ordinance recorded; and fixing the time when this ordinance shall become effective.

SECTION 1. The City Council finds and determines that a portion of a water utility easement located on the Boone Retirement Center property, more particularly described as follows:

A strip of land sixteen (16) feet in width being a part of the water utility easement as described in Book 786 at page 754 and also being a part of Lot 1 of Bluff Creek Office Park Plat 3-D as recorded in Plat Book 30 at page 5, both of the Boone County Records; situate in the northwest quarter of Section 29, Township 48 North, Range 12 West in the City of Columbia, Boone County, Missouri; said strip lying eight (8) feet in width on each side of the following described centerline:

Commencing at the west corner of said Lot 1 on the northeasterly right-of-way line of Old 63 South; thence along said right-of-way line S.45°32°20"E., 157.32 feet to the centerline of the water utility easement in Book 786 at page 754; thence along said centerline N.44°27'40"E., 177.22 feet to the POINT OF BEGINNING of the subject strip; thence continuing N.44°27'40"E., 307.99 feet; thence S.45°32'20"E., 316.70 feet; thence S.88°57'00"E., 26.43 feet to the terminus of the left side of the subject strip at the southwest corner of the water utility easement in Book 1638 at page 471; thence continuing S.88°57'00"E., 41.80 feet to the terminus of the right side of said strip, the line connecting the two ends running N.68°00'10"W., 44.75 feet.

SECTION 2. The City Clerk is hereby authorized and directed to cause a copy of this ordinance to be recorded in the office of the Recorder of Deeds of Boone County, Missouri.
