Section 102-044 Ord. 16756; Agreement w/Columbia Public School District RE: Construction of a Tennis Court Complex at Gentry Middle School and Cosmo-Bethel Park

AN ORDINANCE

authorizing an agreement with the Columbia Public School District; declaring it is in the public interest to proceed with construction of a tennis court complex at Gentry Middle School and Cosmo-Bethel Park; approving plans and specifications for the improvements; calling for bids through the Purchasing Division; determining that a portion of the project shall be done by city employees; providing for payment for the improvement; appropriating funds; providing for compliance with the prevailing wage law; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1. The City Manager is hereby authorized to execute an agreement with the Columbia Public School District for construction of an eight court tennis complex at Gentry Middle School and Cosmo-Bethel Park.  The form and content of the agreement shall be substantially as set forth in "Exhibit A" attached hereto and made a part hereof as fully as if set forth herein verbatim.

    SECTION 2.  Subsequent to the adoption of a resolution by the City Council, declaring the necessity for construction of a tennis court complex at Gentry Middle School and Cosmo-Bethel Park and pursuant to the publication of the resolution in a daily newspaper of general circulation in the City of Columbia, Missouri, and the affidavit of publication filed; and after a public hearing as provided for in Section 75 of the Home Rule Charter, the Council finds and determines that construction of such improvements, including the construction of an eight court tennis complex, are necessary for the welfare and improvement of the city and that it is in the public interest that such improvements be made.

    SECTION 3.  The plans and specifications for these improvements filed in the office of the city clerk, are hereby approved, adopted and made a part hereof by reference as fully as if set forth herein verbatim.

    SECTION 4.  The City Manager, through the head of the purchasing division, is hereby authorized to call for bids for the construction of the tennis complex.  As deemed advisable by the City Manager pursuant to Section 70 of the City Charter, City employees shall be used for site grading and if funds allow, construction of a small shelter.

    SECTION 5. Payment for these improvements shall be made from the 1999 Capital Improvement Sales Tax Funds, funds received from the Columbia Public School District and such other funds as may be lawfully appropriated.
                            
    SECTION 6.  The sum of $ 201,000 is hereby appropriated from the Miscellaneous Revenue Account No. 440-0000-480.10-00 #C00015 to the Rockbridge Tennis Lighting Project Account No. 440-8800-548.49-90 #C00015.

    SECTION 7.  The City shall cause to be inserted into the contract a stipulation to the effect that not less than the prevailing hourly rate of wages, as found by the Department of Labor and Industrial Relations of Missouri, shall be paid to all workers performing work under the contract. The contractor's bond shall include such provisions as will guarantee the faithful performance of the prevailing hourly wage clause, as provided by the contract.

    SECTION 8.  This ordinance shall be in full force and effect from and after its passage.
