Section 102-063 Ord. 16769; Approving the C-P Development Plan of the Daniel Boone Little League; Granting Variances RE: Sidewalk Construction and Landscape Screening

AN ORDINANCE

approving the C-P Development Plan of Daniel Boone Little League; granting variances; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.  The City Council hereby approves the CP Development Plan of Daniel Boone Little League, dated November 2000, located between Gillespie Bridge Road and Chapel Hill Road, extended west of Scott Boulevard.  The Director of Planning and Development shall use the design parameters set forth in ”Exhibit A,” which is attached to and made part of this ordinance as guidance when considering any future revisions to the C-P Development Plan.  

    SECTION 2.  Approval of the CP Development Plan shall be deemed to satisfy the requirements for a Preliminary Plat of a Subdivision.

    SECTION 3.  Subdivider is granted a variance from the requirements of Section 25-48 of the Subdivision Regulations so that sidewalk construction shall be postponed until Chapel Hill Road is constructed.

    SECTION 4.  The City Council approves the property owner’s request that landscape screening not be required along perimeters of the site which are adjacent to residentially-zoned land.

    SECTION 5.  The Approval of this C-P Development plan is subject to the following conditions:

1.    That all right-of-way needed for Chapel Hill road, on land presently owned by the Daniel Boone Little League (estimated to be approximately 29,000 square feet), be dedicated by separate instrument, prior to any occupancy permits being granted.

2.    That hours of nighttime operation be limited to 10:30 p.m.; except that from July 15 to August 15 hours of operation shall be limited to 11:30 p.m.

    3.    That the field lighting be in accordance with the description of Musco brand lighting, which was submitted to the City by the property owner as part of its application for plan approval.
  
    SECTION 6.  This ordinance shall be in full force and effect from and
after its passage.
