Section 102-076 Ord. 16782; Repealing Ordinance No. 16743 RE: Special Election to Grant Adelphia Business Solutions Operations, Inc. a Telecommunications Franchise

AN ORDINANCE

repealing Ordinance No. 016743 which called a special election on April 3, 2001 on the question whether to grant Adelphia Business Solutions Operations, Inc., a telecommunications franchise; directing the city manager to take all necessary actions to have the Adelphia franchise proposition removed from the April ballot; declaring an emergency; and fixing the time when this ordinance shall become effective.

    WHEREAS, the city council on January 16, 2001 passed Ordinance No. 016743 calling a special election in the city to be held on April 3, 2001 on the question whether to grant a twelve year telecommunications franchise to Adelphia Business Solutions Operations, Inc; and

    WHEREAS, Adelphia Business Solutions Operations, Inc. has withdrawn its request for a telecommunications franchise.

    NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.  Ordinance No. 016743 which called a special election for April 3, 2001 on the question whether to grant a twelve year telecommunications franchise to Adelphia Business Solutions Operations, Inc. is hereby repealed.

    SECTION 2. The city manager is hereby directed to have all necessary actions taken to remove the Adelphia Business Solutions Operations, Inc. franchise proposition from the April 3, 2001 ballot.

    SECTION 3.  It is found and declared by the city council that an emergency exists as provided for in Section 15 of the Home Rule Charter for the City of Columbia, Missouri, in that it is necessary to notify the election official of the removal of the Adelphia proposition from the April ballot as soon as possible  to avoid incurring unnecessary election costs.

    SECTION 4.  This ordinance shall be in full force and effect from and after its passage.
