vacating a sanitary sewer easement located within Columbia Mall; accepting conveyances for sewer purposes; directing the City Clerk to have a copy of this ordinance and the conveyances recorded; authorizing the city manager to execute conveyances; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.  The City Council finds and determines that a certain easement located within Columbia Mall, more particularly described as follows:

AN IRREGULAR TRACT OF LAND LOCATED IN THE NORTHWEST QUARTER OF SECTION 10, TOWNSHIP 48 NORTH, RANGE 13 WEST, COLUMBIA, BOONE COUNTY, MISSOURI, BEING PART OF LOT 4, COLUMBIA MALL PLAT NO. 1 RECORDED IN PLAT BOOK 18, PAGE 61, AND BEING PART OF THE SANITARY SEWER EASEMENT ACROSS LOT 1, COLUMBIA MALL PLAT NO. 2 RECORDED IN PLAT BOOK 19, PAGE 32 AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:

COMMENCING AT THE NORTHWEST CORNER OF LOT 4, COLUMBIA MALL PLAT NO. 1 RECORDED IN PLAT BOOK 18, PAGE 61; THENCE WITH THE WEST LINE THEREOF, S5E35'00"W, 443.35 FEET TO THE SOUTHWESTERLY CORNER OF SAID LOT 4; THENCE WITH THE SOUTH LINE THEREOF, S64E25'00"E, 39.11 FEET; THENCE LEAVING SAID SOUTH LINE, S70E52'15"W, 50.32 FEET; THENCE S19E07'45"E, 8.00 FEET TO THE POINT OF BEGINNING; THENCE FROM THE POINT OF BEGINNING N70E52'15"E, 8.00 FEET; THENCE S21E11'00"E, 16.14 FEET; THENCE N58E14'00"E, 73.73 FEET; THENCE N70E52'15"E, 73.13 FEET; THENCE S58E14'00"W, 163.94 FEET; THENCE N21E48'55"W, 35.91 FEET; THENCE N70E52'15"E, 8.00 FEET TO THE POINT OF BEGINNING AND CONTAINING 2314 SQUARE FEET.

is in excess and surplus to the needs of the City and is hereby vacated.

    SECTION 2.  The City Clerk is hereby authorized and directed to cause a copy of this ordinance to be recorded in the office of the Recorder of Deeds of Boone County, Missouri.

    SECTION 3.  The conveyances to the City of Columbia, Missouri, a municipal corporation, more particularly described as follows:

Grant of easement from Dillard’s, Inc., dated January 2001, more particularly described in Exhibit "A" attached hereto and made a part hereof as fully as if set forth herein verbatim.

Grant of easement from Dillard’s, Inc., dated January 2001, more particularly described in Exhibit "B" attached hereto and made a part hereof as fully as if set forth herein verbatim.

Grant of easement from Columbia Mall, L.L.C., a Delaware limited liability company, dated November 7, 2000, more particularly described in Exhibit "C" attached hereto and made a part hereof as fully as if set forth herein verbatim.

are hereby accepted.

    SECTION 4.  The City Clerk is hereby authorized and directed to have the conveyances recorded in the office of the Boone County Recorder of Deeds.

    SECTION 5.  The city manager is authorized to execute Exhibits A and B on behalf of the City.

    SECTION 6.  This ordinance shall be in full force and effect from and after its passage.
