approving the Final Plat of Mohr Subdivision, a minor subdivision; accepting the dedication of rightsofway and easements; authorizing a performance contract; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.  The City Council hereby approves the Final Plat of Mohr Subdivision, dated December 2001, a minor subdivision located on the north side of East Texas Avenue, approximately 400 feet east of North Garth Avenue, containing approximately 1.62 acres in the City of Columbia, Boone County, Missouri, and hereby authorizes and directs the Mayor and City Clerk to sign the plat evidencing such approval.

    SECTION 2.  The City Council hereby accepts the dedication of all rightsofway and easements as dedicated upon the plat.

    SECTION 3.  The approval of the Final Plat of Mohr Subdivision is subject to the following conditions:

    1.    Prior to an occupancy permit being issued for Lot 3, the shared driveway accessing the tier lots on the plat be constructed to a minimum 18-foot width and constructed to a minimum thickness (of either asphalt or concrete) standard for a City of Columbia residential street;

    2.    Prior to an occupancy permit being issued for Lot 3, the addresses of the subject properties on the tier lots be clearly marked at the driveway entrances on East Texas Avenue.

    SECTION 4.  The City Manager is hereby authorized to execute performance contracts with Rebecca L. Mohr and Delia Knipp White in connection with the approval of the Final Plat of Mohr Subdivision.  The form and content of the contracts shall be substantially as set forth in "Exhibits A and B" attached hereto and made a part hereof as fully as if set forth herein verbatim.

    SECTION 5.  This ordinance shall be in full force and effect from and after its passage.
