Section 103-047 Res. 14-02; Setting a Public Hearing RE: Construction of Sanitary Sewers in Sewer District No. 144 (Mexico Gravel Road)

A RESOLUTION
declaring the necessity for construction of sanitary sewers in Sewer District No. 144
(Mexico
Gravel Road); stating the nature of and the estimate of the cost thereof; providing for payment
for the improvement; providing for compliance with the prevailing wage law; and fixing the time
for a public hearing thereon.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS
FOLLOWS:
SECTION 1. The City Council deems the construction of
sanitary sewers, wye branches,
manholes and other necessary appurtenances in Sewer District No. 144 necessary to the welfare
and improvement of the City.
SECTION 2. The nature and scope of the improvement shall
consist of furnishing all labor,
materials, transportation, insurance and all other items, accessories and incidentals thereto
necessary for the complete construction of the improvements.
SECTION 3. The estimated cost of this improvement is $
121,000.
SECTION 4. Payment for this improvement shall be made
by special tax bills evidencing
special assessments levied and assessed against the lots, tracts or parcels of ground specially
benefited in Sewer District No. 144 of the City, in proportion to the area of the whole district
exclusive of public highways, in the manner specified by the laws of the State of Missouri and
the Charter and Ordinances of the City of Columbia, in a unit rate not to exceed $.204 per square
foot; and the balance from Sanitary Sewer Utility Funds and such other funds as may be lawfully
appropriated or lawfully used for such purpose, the boundaries of the sewer district being
described as follows:
BEGINNING at the east quarter corner of Section 33, Township 49 North, Range 12 West;
thence along the north right-of-way line of Mexico Gravel Road S.89E05'00"W., 611.41 feet;
thence leaving said north right-of-way line S.0E15'35"W., 444.30 to the southeast corner of a
tract of land described by a survey in Book 310 at Page 105 of the Boone County Records;
thence along the south line of said tract S.89E47'00"W., 198.32 feet to the east line of 40'
Road
shown by said survey; thence along said 40' Road N.0E10'10"W., 267.87 feet; thence
N.89E19'30"E., 100.59 feet to the west line of a tract of land described in a warranty deed in
Book 511 at Page 105 of the Boone County Records; thence along said west line, and the
extension of same, N.0E08'05"E., 174.38 feet to the north right-of-way line of Mexico Gravel
Road; thence along said north right-of-way line S.89E05'00"W., 442.64 feet to the southwest
corner of a tract of land described in a warranty deed in Book 797 at Page 435, of said records;
thence along the west line of last said tract N.0E56'00"E., 206.57 feet to the northwest corner
of
said tract on the city limit line, also being the southwest corner of Lot 18 of Wellington Estates
Plat 4 as recorded in Plat Book 32 at Page 16, of said records; thence along the south line of said
lot and Lot 17, also being the city limit line, N.88E53'05"E., 711.77 feet to the southeast corner
of said Lot 17; thence leaving said south line and continuing along the city limit line
N.88E53'05"E., 440.85 feet to the west line of a tract of land described in a warranty deed in
Book 711 at Page 758, of said records; thence along said west line (also being the east line of a
private road as recorded in Book 161 at Page 619, of said records) N.0E28'05"E., 551.45 feet to
the northwest corner of said tract; thence along the north line of said tract S.89E27'05"E., 407.97
feet to the northeast corner of said tract; thence along the east line of said tract S.1E06'00"W.,
720.99 feet to the southeast corner of said tract on the north right-of-way line of Route PP;
thence along the south line of said tract and said north right-of-way line N.89E23'40"W., 87.40
feet; thence continuing along said lines on a curve to the left having a radius of 353.31 feet a
distance of 176.22 feet (the chord of said curve having bearing and distance of S.76E04'15"W.,
174.40 feet); thence along the quarter section line of Section 34, Township 49 North, Range 12
West N.88E26'55"W., 143.74 feet to the POINT OF BEGINNING and containing 13.56 acres
exclusive of road right-of-way.
SECTION 5. Any work done in connection with the construction
of the improvement
specified above shall be in compliance with the provisions of the prevailing wage laws of the
Department of Labor and the State of Missouri, such prevailing wage rates having been
established by the Industrial Commission of Missouri.
SECTION 6. This resolution shall be published in a daily
newspaper of general circulation in
the City of Columbia for seven (7) consecutive insertions, and a public hearing in respect to this
improvement will be held in the Council Chamber of the Daniel Boone Building, 701 E.
Broadway, Columbia, Missouri, at 7 o'clock p.m., on February 4, 2002.
