AN ORDINANCE
declaring it is in the public interest to proceed with construction of improvements to Cosmo-Bethel
Park and Kiwanis Park; approving plans and specifications for the improvements; calling
for bids through the Purchasing Division; determining that a portion of the project shall be done
by city employees; providing for payment for the improvement; providing for compliance with
the prevailing wage law; and fixing the time when this ordinance shall become effective.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS
FOLLOWS:
SECTION 1. After the adoption of a resolution by the City Council, declaring
the necessity
for construction of improvements to Cosmo-Bethel Park and Kiwanis Park and after an
advertised public hearing, the Council finds and determines that construction of such
improvements, including asphaltic overlay and repair/replacement of curbing to the parking lots
and roadways, is necessary for the welfare and improvement of the city and that it is in the public
interest that such improvements be made.
SECTION 2. The plans and specifications for these improvements filed in
the office of the
city clerk, are hereby approved, adopted and made a part hereof by reference as fully as if set
forth herein verbatim.
SECTION 3. The City Manager, through the head of the purchasing division,
is hereby
authorized to call for bids and award a contract for the asphalt overlay work. As deemed
advisable by the City Manager, city employees shall repair the roads and repair or replace the
damaged curbs.
SECTION 4. Payment for Cosmo-Bethel Park improvements shall be made from
the Capital
Improvement Sales Tax Fund, and such other funds as may be lawfully appropriated. Payment
for Kiwanis Park improvements shall be made from the Local Parks Sales Tax Fund and such
other funds as may be lawfully appropriated.
SECTION 5. The City shall cause to be inserted into the contract a stipulation
to the effect
that not less than the prevailing hourly rate of wages, as found by the Department of Labor and
Industrial Relations of Missouri, shall be paid to all workers performing work under the contract.
The contractor's bond shall include such provisions as will guarantee the faithful performance of
the prevailing hourly wage clause, as provided by the contract.
SECTION 6. This ordinance shall be in full force and effect from and after
its passage.
