AN ORDINANCE
declaring it is in the public interest to proceed with construction of improvements to Indian Hills
Park; approving plans and specifications for the improvements; calling for bids through the
Purchasing Division; determining that a portion of the project shall be done by city employees;
providing for payment for the improvement; providing for compliance with the prevailing wage
law; and fixing the time when this ordinance shall become effective.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS
FOLLOWS:
SECTION 1. After the adoption of a resolution by the City Council, declaring
the necessity for
construction of improvements to Indian Hills Park and after an advertised public hearing, the
Council finds and determines that construction of such improvements, including the development
of a new playground, new soccer field practice area, 10-foot wide perimeter park trail,
installation of fencing along south boundary of park, and development of a new 18 hole disc golf
course, is necessary for the welfare and improvement of the city and that it is in the public
interest that such improvements be made.
SECTION 2. The plans and specifications for these improvements filed in
the office of the
city clerk, are hereby approved, adopted and made a part hereof by reference as fully as if set
forth herein verbatim.
SECTION 3. The City Manager, through the head of the purchasing division,
is hereby
authorized to call for bids and award a contract for the majority of the earthwork. As deemed
advisable by the City Manager, city employees shall be used to construct the other
improvements.
SECTION 4. Payment for this improvement shall be made from Community Development
Block Grant Funds, and such other funds as may be lawfully appropriated.
SECTION 5. The City shall cause to be inserted into the contract a stipulation
to the effect
that not less than the prevailing hourly rate of wages, as found by the Department of Labor and
Industrial Relations of Missouri, shall be paid to all workers performing work under the contract.
The contractor's bond shall include such provisions as will guarantee the faithful performance of
the prevailing hourly wage clause, as provided by the contract.
SECTION 6. The City shall also cause to be inserted into the contract
a stipulation that all
laborers and mechanics employed by the contractor or subcontractors in the performance of work
under the contract shall be paid wages at rates not less than those prevailing on similar
construction in the locality as determined by the Secretary of Labor in accordance with the
Davis-Bacon Act.
SECTION 7. This ordinance shall be in full force and effect from and after
its passage.
