Ordinance No.            17225              Council Bill No.           B 87-02            

vacating all street right-of-way and easements within Greenhaven Subdivision; abrogating the Final Plat of Greenhaven Subdivision; accepting conveyance for utility purposes; directing the City Clerk to have a copy of this ordinance and the conveyance recorded; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.  The City Council finds and determines that street right-of-way and easements within Greenhaven Subdivision, more particularly described as follows:

Any and all easements and rights-of-way associated with the plat of Greenhaven Subdivision as recorded in Plat Book 26, Page 32, Deed Records of Boone County, Missouri, being located in the Southwest Quarter (SW1/4) of Section 9, Township 48 North, Range 13 West, Boone County, Missouri.

are in excess and surplus to the needs of the City and are hereby vacated.

    SECTION 2.  The Final Plat of Greenhaven Subdivision, recorded in Book 26, Page 32 of the Boone County, Missouri records, is hereby abrogated.

    SECTION 3.  The City of Columbia accepts the following conveyance:

Grant of Easement for utility purposes from Donald S. and Dana R. Fritz, dated February 22, 2002, a copy of which, marked "Exhibit A" is attached to this ordinance.

    SECTION 4.  The City Clerk is authorized and directed to have a copy of this ordinance and the conveyance recorded in the office of the Boone County Recorder of Deeds.

    SECTION 5.  This ordinance shall be in full force and effect from and after its passage.
