Section 103-253; Ord. 17288; Authorizing Voter Approved Annexation of the "South Area" to the City of Columbia, Missouri

AN ORDINANCE

providing for the extension of the corporate limits of the City of Columbia, Missouri, by annexing, embracing and including within the city limits unincorporated real property located in Boone County, Missouri lying south of the city limits of Columbia; and fixing the time when this ordinance shall become effective.

    WHEREAS, on the 4th day of March, 2002, the City of Columbia, Missouri, declared by resolution of the City Council its intent to annex the hereinafter described unincorporated territory into the City of Columbia, Missouri; and

    WHEREAS, a public hearing was held on the proposed annexation on the 6th day of May, 2002, at which hearing a “Plan of Intent” to provide services to the proposed annexation area was presented along with evidence in support thereof.

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.  That the corporate limits of the City of Columbia in the County of Boone, state of Missouri, be extended so as to embrace and include all that part of Boone County lying within the following boundary lines, to-wit:
    
A tract of land in the southeast and southwest quarters of Section 36, Township 48 North, Range 13 West; the northeast, southeast and southwest quarters of Section 31; the northeast, southeast, southwest and northwest quarters of Section 32; the southeast, southwest and northwest quarters of Section 33, all in Township 48 North, Range 12 West; the fractional northwest quarter of Section 4, the fractional north half of Section 5 and the fractional north half of Section 6, all in Township 47 North, Range 12 West and the fractional northeast quarter of Section 1, Township 47 North, Range 13 West,  in Boone County, Missouri, said tract being further described as follows:

BEGINNING at the common corner to Sections 28, 29, 32 and 33, Township 48 North, Range 12 West; thence westerly along the south line of said Section 29, to the north quarter corner of Section 32, Township 48 North, Range 12 West; thence South along the quarter section line 682.8 feet; thence S.88°21'W., 1095.2 feet to a line being 25 feet east of and parallel with the centerline of an existing roadway; thence S.88°21'00"W., 67.16 feet;     SECTION 2.  The perimeter of the area as above described is approximately 52,325 feet and the length of the contiguous boundary common to the existing corporate limits of the City of Columbia and the area being annexed is approximately 30,360 feet, which length is equal to at least fifteen percent (15%) of the length of the perimeter of the area proposed for annexation.

    SECTION 3.  The City Council hereby determines that the proposed annexation is reasonable and necessary to the proper development of the City of Columbia.

    SECTION 4.  The City has developed a “Plan of Intent” to provide services to the area proposed for annexation on the same basis upon which services are presently provided to the residents of the City.  Said Plan of Intent is attached hereto and incorporated by reference as if fully set out herein.

    SECTION 5.  The annexation of the territory described in Section 1 is subject to the approval of the voters of the City and the voters of the area subject to annexation in an election to be held on August 6, 2002.

    SECTION 6.  Upon a favorable vote, as certified by the election authority, the annexation shall become effective as of October 1, 2003 unless at such time a lawsuit to authorize the annexation filed pursuant to state law is pending before the courts in which instance the annexation shall become effective upon the final affirmative action of the appropriate court.
    
    SECTION 7.  This ordinance shall be in full force and effect from and after its passage.
