Section 103-264; Ord. 17299; Calling a Special Election on August 6, 2002 RE: Annexation of the "South Area"

AN ORDINANCE

calling a special election in the City of Columbia, Missouri, to be held on Tuesday, August 6, 2002, on the question whether to extend the corporate limits of the City of Columbia; directing notification of the election authority; describing the form of the notice of election; and fixing the time when this ordinance shall become effective.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.  A special election is hereby ordered to be held in the City of Columbia, Missouri, on Tuesday, August 6, 2002, on the following question:

PROPOSITION 5
SOUTH AREA

Shall the corporate limits of the City of Columbia, Missouri be extended to embrace and include approximately 1.9 square miles of property located to the south of the current city limits, beginning along the west right of way of Providence Road and continuing South to Old Plank Road then heading East along Highway 163 and continuing East along a line 200 feet South of Gans Road and then along the south right of way of Gans Road as it turns northeast to the west right of way of Highway 63 then South along the west right of way of Ponderosa Street approximately 1,500 feet then East across Highway 63 and North approximately 1,200 feet and then West, back to the east right of way of Highway 63 and Northwest to the Columbia city limits and including the area served by private streets off of Lenoir Street?

    SECTION 2.  Upon a favorable vote, as certified by the election authority, the annexation shall become effective as of October 1, 2003 unless at such time a lawsuit to authorize the annexation filed pursuant to state law is pending before the courts in which instance the annexation shall become effective upon the final affirmative action of the appropriate court.

    SECTION 3.  The City Clerk is hereby authorized and directed to notify the Clerk of the County Commission of Boone County, Missouri, of the adoption of this ordinance no later than 5 o'clock p.m. on May 28, 2002, and to include in the notification all of the terms and provisions required by Chapter 115, RSMo. 1994, as amended.

    SECTION 4.  The form of the notice of election shall be substantially as set forth on "Exhibit A" attached hereto and made a part hereof as fully as if set forth herein verbatim.

    SECTION 5.  The election shall be held and conducted, and the results thereof canvassed and returned, in all respects in accordance with the laws of the State of Missouri and the Charter and Ordinances of the City of Columbia, Missouri.

    SECTION 6.  This ordinance shall be in full force and effect from and after its passage.

Notice is hereby given to the qualified voters of the City of Columbia, Missouri, that the City Council of the City has called an election to be held in the City on Tuesday, August 6, 2002, commencing at six o'clock a.m. and closing at seven o'clock p.m., on the question contained in the following sample ballot:
