Section 103-283; Ord. 17301; Authorizing Voter Approved Annexation of Property Lying West of the City Limits

AN ORDINANCE

providing for the extension of the corporate limits of the City of Columbia, Missouri, by annexing, embracing and including within the city limits unincorporated real property located in Boone County, Missouri lying west of the city limits of Columbia; and fixing the time when this ordinance shall become effective.

    WHEREAS, on the 4th day of March, 2002, the City of Columbia, Missouri, declared by resolution of the City Council its intent to annex the hereinafter described unincorporated territory into the City of Columbia, Missouri; and

    WHEREAS, a public hearing was held on the proposed annexation on the 6th day of May, 2002, at which hearing a “Plan of Intent” to provide services to the proposed annexation area was presented along with evidence in support thereof.

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.  That the corporate limits of the City of Columbia in the County of Boone, state of Missouri, be extended so as to embrace and include all that part of Boone County lying within the following boundary lines, to-wit:
    
A tract of land in the east half of Section 12, Township 48 North, Range 14 West; the northeast quarter of Section 17,  the fractional southwest quarter of Section 6, in Section 7 and in Section 8, all in Township 48 North, Range 13 West and in the fractional northeast quarter of Section 1, Township 48 North, Range 14 West, in Boone County, Missouri; said tract being described as follows:

BEGINNING at the common corner to Sections 4,5,8 and 9 in Township 48 North, Range 13 West; thence along the section line, N.7°55'15'W., 145.6 feet to the north rightofway line of Interstate Highway 70; thence westerly 7670 feet, more or less, to a point 200 feet east of the west line of the northeast quarter of said Section 7; thence N.0°21'W. parallel with said quarter line 1269 feet to the easterly prolongation of the south line of the tract described in the warranty deed in Book 436 at page 686; thence N.89°23'W., 200 feet to the southeast corner of said tract; thence along the lines of said tract, N.89°23'W., 450.00 feet; thence N.0°37'E., 237.78 feet; thence S.85°59'W., 1433.62 feet; thence N.0°01'W., 128.00 feet to the northwest corner of said tract at the southwest corner of Boone County Survey No.7969;     SECTION 2.  The perimeter of the area as above described is approximately 48,101 feet and the length of the contiguous boundary common to the existing corporate limits of the City of Columbia and the area being annexed is approximately 13,306 feet, which length is equal to at least fifteen percent (15%) of the length of the perimeter of the area proposed for annexation.

    SECTION 3.  The City Council hereby determines that the proposed annexation is reasonable and necessary to the proper development of the City of Columbia.

    SECTION 4.  The City has developed a “Plan of Intent” to provide services to the area proposed for annexation on the same basis upon which services are presently provided to the residents of the City.  Said Plan of Intent is attached hereto and incorporated by reference as if fully set out herein.
    SECTION 5.  The annexation of the territory described in Section 1 is subject to the approval of the voters of the City and the voters of the area subject to annexation in an election to be held on August 6, 2002.

    SECTION 6.  Upon a favorable vote, as certified by the election authority, the annexation shall become effective as of October 1, 2003 unless at such time a lawsuit to authorize the annexation filed pursuant to state law is pending before the courts in which instance the annexation shall become effective upon the final affirmative action of the appropriate court.

    SECTION 7.  This ordinance shall be in full force and effect from and after its passage.
