AN ORDINANCE

calling a special election in the City of Columbia, Missouri, to be held on Tuesday, August 6, 2002, on the question whether to extend the corporate limits of the City of Columbia; directing notification of the election authority; describing the form of the notice of election; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.  A special election is hereby ordered to be held in the City of Columbia, Missouri, on Tuesday, August 6, 2002, on the following question:

PROPOSITION 1
EAST AREA

Shall the corporate limits of the City of Columbia, Missouri be extended to embrace and include approximately 2.26 square miles of property located to the east of the current city limits beginning approximately one-half mile North of New Haven Road and extending North to Richland Road (excluding the property along the southern portion of Rustic Road) and East along Route WW and Richland Road and North of Interstate 70 along Clark Lane and St. Charles Road and including several islands of unincorporated Boone County North of New Haven Road and West of Warren Drive, North and South of St. Charles Road and South and East along North Grace Lane?
    
    SECTION 2.  Upon a favorable vote, as certified by the election authority, the annexation shall become effective as of October 1, 2003 unless at such time a lawsuit to authorize the annexation filed pursuant to state law is pending before the courts in which instance the annexation shall become effective upon the final affirmative action of the appropriate court.

    SECTION 3.  The City Clerk is hereby authorized and directed to notify the Clerk of the County Commission of Boone County, Missouri, of the adoption of this ordinance no later than 5 o'clock p.m. on May 28, 2002, and to include in the notification all of the terms and provisions required by Chapter 115, RSMo. 1994, as amended.

    SECTION 4.  The form of the notice of election shall be substantially as set forth on "Exhibit A" attached hereto and made a part hereof as fully as if set forth herein verbatim.

    SECTION 5.  The election shall be held and conducted, and the results thereof canvassed and returned, in all respects in accordance with the laws of the State of Missouri and the Charter and Ordinances of the City of Columbia, Missouri.

    SECTION 6.  This ordinance shall be in full force and effect from and after its passage.
