Section 103-286; Ord. 17304; Calling an Election RE: Voter Approved Annexation of Property Located West of the City Limits

AN ORDINANCE

calling a special election in the City of Columbia, Missouri, to be held on Tuesday, August 6, 2002, on the question whether to extend the corporate limits of the City of Columbia; directing notification of the election authority; describing the form of the notice of election; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.  A special election is hereby ordered to be held in the City of Columbia, Missouri, on Tuesday, August 6, 2002, on the following question:

PROPOSITION 2
WEST AREA

Shall the corporate limits of the City of Columbia, Missouri be extended to embrace and include approximately 1.9 square miles of property located to the west of the current city limits beginning at the western most city limits just north of Interstate 70 and following the Interstate 70 right-of-way line West to Schotte Lane, then going Northwest approximately 1 mile on both sides of Highway 40 approximately 1/4 mile and also extending South of the Midway interchange of Interstate 70 for approximately 1 mile and then East to the Columbia city limits?

    SECTION 2.  Upon a favorable vote, as certified by the election authority, the annexation shall become effective as of October 1, 2003 unless at such time a lawsuit to authorize the annexation filed pursuant to state law is pending before the courts in which instance the annexation shall become effective upon the final affirmative action of the appropriate court.

    SECTION 3.  The City Clerk is hereby authorized and directed to notify the Clerk of the County Commission of Boone County, Missouri, of the adoption of this ordinance no later than 5 o'clock p.m. on May 28, 2002, and to include in the notification all of the terms and provisions required by Chapter 115, RSMo. 1994, as amended.

    SECTION 4.  The form of the notice of election shall be substantially as set forth on "Exhibit A" attached hereto and made a part hereof as fully as if set forth herein verbatim.

    SECTION 5.  The election shall be held and conducted, and the results thereof canvassed and returned, in all respects in accordance with the laws of the State of Missouri and the Charter and Ordinances of the City of Columbia, Missouri.

    SECTION 6.  This ordinance shall be in full force and effect from and after its passage.
