Section 103-329; Ord. 17338; Vacating a Drainage Easement Located Within Broadway Farms Subdivision, Plat No. 15; Accepting Conveyance for Drainage Purposes

AN ORDINANCE

vacating a portion of a drainage easement located within Broadway Farms Subdivision, Plat No. 15; directing the City Clerk to have a copy of this ordinance recorded; accepting a  conveyance for drainage purposes; directing the City Clerk to have the conveyance recorded; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.  The City Council finds and determines that a portion of a 16-foot drainage easement located within Broadway Farms Subdivision, Plat No. 15, more particularly described as follows:

A tract of land 16 feet in width located in the Northeast quarter of Section 16, Township 48 North, Range 13 West in Columbia, Boone County, Missouri being a part of Lot 3 of Broadway Farms Plat No. 15 as recorded in Plat Book 35 at page 42 of the Boone County Records and said tract being 8 feet each side of the following described centerline:

Starting at the Northeast corner of said Lot 3; thence with the North line of Lot 3, N 84E25'00"W, 177.37 feet; thence leaving said North line S 5E35'20"W, 24.00 feet to the beginning of this centerline description; thence continuing S 5E35'20"W, 41.90 feet; thence S 69E56'40"W, 192.20 feet to the east line of an existing 20 foot drainage and utility easement and the end of the centerline description.

is in excess and surplus to the needs of the City and is hereby vacated.

    SECTION 2.  The City Clerk is hereby authorized and directed to cause a copy of this ordinance to be recorded in the office of the Recorder of Deeds of Boone County, Missouri.


    SECTION 3.  The conveyance to the City of Columbia, Missouri, a municipal corporation, more particularly described as follows:

Grant of Easement from Broadway and Broadfield Properties, LLC, dated May 13, 2002, more particularly described in Exhibit "A" attached hereto and made a part hereof as fully as if set forth herein verbatim.

is hereby accepted.

    SECTION 4.  The City Clerk is hereby authorized and directed to have the conveyance recorded in the office of the Boone County Recorder of Deeds.

    SECTION 5.  This ordinance shall be in full force and effect from and after its passage.
