Section 103-353; Defeated B218-02; Voluntary Annexation of Property Located on the SW Side of Ponderosa Street, SE of Blue Acres Mobile Home Park; Establishing Permanent R-3 Zoning (Philips Tract)

on the southwest side of Ponderosa Street, southeast of the Blue Acres Mobile Home Park;
placing the property annexed in District R-3; and fixing the time when this ordinance shall
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS
SECTION 1. The City Council hereby finds that a verified petition was
filed with the City on
May 10, 2002, requesting the annexation of land which is contiguous and compact to the existing
corporate limits of the City and which is described in Section 4 of this ordinance. This petition
was signed by A. Perry Philips Family Partnership, L.L.P., et. al., the sole owners of the fee
interest of record in the land proposed to be annexed. A public hearing was held concerning this
matter on June 17, 2002. Notice of this hearing was published more than seven days prior to the
hearing in two newspapers of general circulation qualified to publish legal matters. At the public
hearing all interested persons, corporations and political subdivisions were permitted to present
evidence regarding the proposed annexation.
SECTION 2. The Council determines that the annexation is reasonable and
necessary to the
proper development of the City and that the City has the ability to furnish normal municipal
services to the area to be annexed within a reasonable time.
SECTION 3. The Council determines that no written objection to the proposed
been filed within fourteen days after the public hearing.
SECTION 4. The City Council hereby extends the city limits by annexing
the land described
in Section 1-11.97 of the Code of Ordinances of the City of Columbia, Missouri, which is hereby
added to Chapter 1 of the City Code and which reads as follows:
Section 1-11.97. July, 2002 Extension of Corporate Limits.
The corporate limits of the City of Columbia shall include the following land:
A TRACT LOCATED IN THE NORTHEAST QUARTER OF SECTION 32, TOWNSHIP 48
NORTH, RANGE 12 WEST, BOONE COUNTY, MISSOURI AND BEING MORE
PARTICULARLY DESCRIBED AS FOLLOWS.
COMMENCING AT THE NORTHWEST CORNER OF THE NORTHEAST QUARTER OF
SECTION 32, TOWNSHIP 48 NORTH, RANGE 12 WEST; THENCE WITH THE QUARTER
SECTION LINE, S2E52'30"E, 1057.46 FEET TO THE POINT OF BEGINNING, SAID POINT
ALSO BEING THE SOUTHWEST CORNER OF A SURVEY RECORDED IN BOOK 253,
PAGE 193 OF THE RECORDS OF BOONE COUNTY; THENCE WITH THE LINES OF
SAID SURVEY, N86E27'00"E, 400.00 FEET; THENCE N33E50'00"E, 1032.29 FEET TO A
POINT ON THE SOUTHWESTERLY R/W LINE OF U.S. HIGHWAY 63 SOUTH; THENCE
SOUTHEASTERLY ALONG SAID R/W LINE TO A POINT ON THE EAST LINE OF SAID
SECTION 32-48-12; THENCE SOUTHERLY ALONG THE EAST LINE OF SAID SECTION
TO A POINT 2178.00 FEET FROM THE NORTHEAST CORNER OF SAID SECTION 32-48-12; THENCE WESTERLY TO A POINT
ON THE QUARTER SECTION LINE, SAID POINT
BEING 1142.50 FEET FROM THE POINT OF BEGINNING; THENCE NORTHERLY
ALONG THE QUARTER SECTION LINE, 1142.50 FEET TO THE POINT OF BEGINNING
AND CONTAINING 75 ACRES, MORE OR LESS.
SECTION 5. The City Clerk is hereby authorized and directed to cause three
of this ordinance to be filed with the Clerk of Boone County, Missouri.
SECTION 6. The property described in Section 4 is in the Sixth Ward.
SECTION 7. The Zoning District Map established and adopted by Section
294 of the Code of
Ordinances of the City of Columbia, Missouri, is hereby amended so that the property described
in Section 4 will be zoned and become a part of District R-3 (Medium Density Multiple-Family
