Section 103-383; Ord. 17372; Rezoning Four Parcels of Property Located on the North Side of I-70 Drive NW from A-1 and C-P to R-2 and M-R

AN ORDINANCE

rezoning four parcels of property located on the north side of I-70 Drive Northwest, west of Garden Drive; repealing all conflicting ordinances or parts of ordinances; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.  The Zoning District Map established and adopted by Section 294 of the Code of Ordinances of the City of Columbia, Missouri, is amended so that the following property:
    
    Tract A
A tract of land in the southeast quarter of the southeast quarter of Section 4, T48N, R13W, Columbia, Boone County, Missouri, being Lots 37 through 40 of Valley View South, Plat 2, Columbia, Missouri, as shown in Plat Book 36, Page 36 of the Boone County records.  1.23 acres total.

    Tract B
A tract of land in the southeast quarter of the southeast quarter of Section 4, T48N, R13W, Columbia, Boone County, Missouri, being Lots 42 through 45 of Valley View South, Plat 2, Columbia, Missouri, as shown in Plat Book 36, Page 36 of the Boone County records.  2.73 acres total.

will be rezoned and become a part of District R-2 (Two-Family Dwelling District) and taken away from District A-1 (Agricultural District).  

    SECTION 2.  The Zoning District Map established and adopted by Section 294 of the Code of Ordinances of the City of Columbia, Missouri, is amended so that the following property:
    
    Tract C
A tract of land in the southeast quarter of the southeast quarter of Section 4, T48N, R13W, Columbia, Boone County, Missouri, being Lot 41 of Valley View South, Plat 2, Columbia, Missouri, as shown in Plat Book 36, Page 36 of the Boone County records.  2.39 acres.

    Tract D
A tract of land in the southeast quarter of the southeast quarter of Section 4, T48N, R13W, Columbia, Boone County, Missouri, being Lots 46 and 47 of Valley View South, Plat 2, Columbia, Missouri, as shown in Plat Book 36, Page 36 of the Boone County records.  6.18 acres total.

will be rezoned and become a part of District M-R (Research, Development and Office Park District) and taken away from District A-1 (Agricultural District) and District C-P (Planned Business District).  The property may be used for the following:

    -Administrative and professional offices, not to include research laboratories;
    -Commercial storage and wholesale distribution warehouses for all materials and products, except for feed, fertilizer, grains, soil conditioners, hazardous materials, asphalt, brick, cement, gravel, rock, sand, and similar construction materials, or fuels;
    -Mechanical and construction contractors and trade shops;
    -Public utility buildings and service facilities, electric transmission and distribution substations, and public utility service centers; and
    -Structures and uses clearly accessory and necessary to the normal operation of the above uses.

    SECTION 3.  All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

    SECTION 4.  The rezoning for Tract D described in section 2 of this ordinance is subject to the condition that the M-R Development Plan for Tract D include a landscape buffer between 50 and 150 feet in width, along the north side of Tract D and that the M-R Development Plan for Tract C include a 25 foot landscape buffer along the west side of Tract C.

    SECTION 5.  This ordinance shall be in full force and effect from and after its passage.
