AN ORDINANCE
amending Chapter 11 of the City Code as it relates to weeds; and fixing the time when this
ordinance shall become effective.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS
FOLLOWS:
SECTION 1. Chapter 11 of the Code of Ordinances of the City of Columbia,
Missouri, is
hereby amended as follows:

DIVISION 4. WEEDS

Sec. 11-254. Defense.
(a) It is an affirmative defense that the defendant did not have the legal
right to control the
location where a violation of this division occurred.
(b) It is an affirmative defense that the growth of weeds was for agricultural
purposes, provided
that a fifteen foot wide, weed-free buffer was maintained on the perimeter of the property
wherever the property adjoins property used for residential or commercial purposes.
(c) It is an affirmative defense that the growth of weeds was part
of a federal or state
agricultural or conservation program.

SECTION 2. This ordinance shall be in full force and effect from and after
its passage.
