Section 103-403; Ord. 17387; Vacating Easements and Street Right-of-way within Timberlane Subdivision, Plat 2

AN ORDINANCE

vacating easements and street right-of-way within Timberlane Subdivision, Plat 2; directing the City Clerk to have a copy of this ordinance recorded; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.  The City Council finds and determines that certain easements and street right-of-way within Timberlane Subdivision, Plat 2, more particularly described as follows:

A 47 foot wide right of way, located in the southeast quarter of section 33, township 49 north, range 12 west, City of Columbia, Boone County, Missouri, said right of way being part of the tract described by the deed in book 1842 page 995, and being part of Joshua Tree Court as shown by Timberlane Subdivision Plat 2 in Plat Book 28 page 37, all of the Boone County records, said right of way being all that part of the cul de sac adjacent, abutting and adjoining lots 20, 21, 22 and 23 of said Timberlane Subdivision Plat 2.

A 16 foot wide utility and drainage easement, located in the southeast quarter of section 33, township 49 north, range 12 west, City of Columbia, Boone County, Missouri, said easement being part of the tract described by the deed in book 1842 page 995, and being part of lots 21, 22 and 32 of Timberlane Subdivision Plat 2 in Plat Book 28 page 37, all of the Boone County records, said easement being 8 feet wide on each side of the following described centerline:

Starting at the southwest corner of said lot 21; thence with the south line of said lot 21, N 85E03'00" E, 256.50 feet to the point of beginning; Thence from the point of beginning with the common line of said lot 21 and 32, N 37E11'15" E, 188.80 feet to a common corner of said lots 21, 22 and 32; Thence leaving said common line of said lots 21 and 32, and with the common line of said lots 21 and 22, N 63E41'30" W, 134.85 fee; thence N 05E12'45" W, 125.00 to the end of this centerline and easement.

A 16 foot wide sanitary sewer easement, located in the southeast quarter of section 33, township 49 north, range 12 west, City of Columbia, Boone County, Missouri, said easement being part of the tract described by the deed in book 1842 page 995, and being part of lots 18, 19, 20, 21 of Timberlane Subdivision Plat 2 in Plat Book 28 page 37, all of the Boone County records, said easement being 8 feet wide on each side of the following described centerline:

Starting at the southwest corner of said lot 21; thence with the south line of said lot 21, N 85E03'00" E, 256.50 feet; thence leaving said south line and with the common line of said lot 21 and 32, N 37E11'15" E, 188.80 feet to a common corner of said lots 21, 22 and 32; thence leaving said common line of said lots 21 and 32, and with the common line of said lots 21 and 22, N 63E41'30" W, 134.85 feet to the point of beginning;

Thence from the point of beginning, leaving said common line, N 69E40'00" W, 169.25 feet to a point on a common line of said lots 20 and 21; thence N 10E27'30" E, 154.40 feet to the southerly common corner of said lots 18 and 19; thence with the common line of said lots 18 and 19, N 05E12'45" E, 125.00 feet to the northerly common corner of said lots 18 and 19 also being a point on the south right of way line of Timber Lane, the end of this centerline and easement.

A 10 foot wide utility easement, located in the southeast quarter of section 33, township 49 North, range 12 west, City of Columbia, Boone County, Missouri, said easement being part of the tract described by the deed in book 1842 page 995, and being part of lots 21, 22, 23 and 32 of Timberlane Subdivision Plat 2 in plat book 28 page 37, all of the Boone County records, said easement being 10 feet wide adjoining, abutting and adjacent to all that right of way of Joshua Tree Court as shown by said Timberlane Subdivision Plat 2, adjacent to said lots 21, 22, 23 and 32.

are in excess and surplus to the needs of the City and are hereby vacated.

    SECTION 2.  The City Clerk is hereby authorized and directed to cause a copy of this ordinance to be recorded in the office of the Recorder of Deeds of Boone County, Missouri.

    SECTION 3.  This ordinance shall be in full force and effect from and after its passage.
