Section 103-431; Res. 151-02; Granting a Permit to Remove a Portion of the Downtown Canopy Located in Front of 872 Broadway

A RESOLUTION

granting a permit to remove that portion of the downtown canopy located in front of 872 Broadway, subject to conditions.

    WHEREAS, Chapter 6, Article II, Section 6-17 of the City Code amending Section 3203.11.6 of the BOCA Basic Building Code provides, in part, that a permit to remove the downtown canopy must be obtained from the City Council prior to removal; and

    WHEREAS, Bob Lemone has requested approval of the City Council to remove that portion of the downtown canopy located in front of his building at 872 Broadway, Columbia, Missouri; and

    WHEREAS, the Metropolitan Improvement Company of Columbia, Inc. asserts ownership over the downtown canopy.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.  The City of Columbia hereby grants Bob Lemone a permit to remove the section of the downtown canopy located in the public right-of-way at 872 Broadway, in accordance with Chapter 6, Article II, Section 6-17 of the City Code amending Section 3203.11.6 of the BOCA Basic Building Code, provided that:

    A.    The Metropolitan Improvement Company of Columbia, Inc. grants permission for the removal of that portion of the downtown canopy.

    B.    Mr. Lemone pays one-half of the cost (not to exceed $1,000) of the material required to replace the lights and electrical equipment currently located on the canopy.
