AN ORDINANCE

granting a variance from the Subdivision Regulations regarding sidewalk construction along the south side of Chapel Hill Road, extended, west of Scott Boulevard, adjacent to Stonecrest, Plat 3 and Stonecrest, Plat 4; directing the City Clerk to record a certified copy of this ordinance; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.   Subdivider is granted a variance from the requirements of Section 25-48.1 of the Subdivision Regulations so that a sidewalk shall not be required along the south side of Chapel Hill Road, extended, west of Scott Boulevard, adjacent to Stonecrest, Plat 3 Lots 98-102 and 113-115 and Stonecrest, Plat 4 Lots 126-128 and 140-141.  The variance is subject to the condition that the property owner shall pay the City the equivalent cost of construction of a conventional sidewalk.  The equivalent cost of construction of a conventional sidewalk shall be defined as the City’s average cost of constructing portland cement concrete sidewalks by public bid during the two (2) calendar years prior to the year in which the variance request is submitted. Payment of the equivalent cost of a conventional sidewalk shall occur prior to issuance of the certificate of occupancy.  Each payment made under this section shall be used to construct a sidewalk along the unimproved street adjacent to the property for which the payment was made.  The sidewalk shall be constructed when the street is constructed to City standards.

    SECTION 2.  The City Clerk is hereby directed to have a certified copy of this ordinance recorded in the office of the Boone County Recorder of Deeds.

    SECTION 3.  This ordinance shall be in full force and effect from and after its passage.
