AN ORDINANCE

changing the uses allowed on C-P zoned property located on the west side of South Providence Outer Roadway, approximately 3,000 feet north of Green Meadows Road; approving the C-P Development Plan of Stoney Creek; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.  The uses allowed on the following C-P (Planned Business District) zoned property:

Tract C: A tract of land located in the southwest 1/4 of Section 24, and in the northwest 1/4 of Section 25, both in Township 48 North, Range 13 West, Columbia, Boone County, Missouri, said tract being part of the tract shown by the survey recorded in Book 1305, Page 65, Records of Boone County, and being more particularly described as follows:  

Commencing at the southwest corner of said survey; thence N0E10'15"W, 258.20 feet; thence S72E17'30"E, 209.21 feet; thence S16E48'40"E, 22.94 feet; thence S81E50'00"E, 27.01 feet to the point of beginning; thence N9E49'45"E, 544.39 feet; thence S60E00'00"E, 133.23 feet; thence S50E18'55"E, 264.83 feet; thence S29E01'10"E, 170.26 feet; thence S9E00'15"E, 230.83 feet; thence N81E50'00"W, 536.27 feet to the point of beginning and containing 4.63 acres.  

are changed from all C-1 permitted uses to all C-1 permitted uses, hotel/motel and uses accessory to a hotel/motel such as a restaurant, bar and swimming pool facility.

    SECTION 2.  The City Council hereby approves the C-P Development Plan of Stoney Creek, dated July 25, 2002, located on the west side of Old Route K/South Providence Outer Roadway, approximately 3,000 feet north of the intersection of Green Meadows Road and South Providence Roadway/State Route 163, containing approximately 9.83 acres.  The Director of Planning and Development shall use the design parameters set forth in “Exhibit A” which is attached to and made a part of this ordinance as guidance when considering any future revisions to the C-P Development Plan.  The approval of the C-P Development Plan is subject to the following conditions:

    1)    The freestanding signs on the site shall be limited to one free-standing pole sign with a maximum height of 22 feet and a maximum surface area of 101 square feet and one monument sign with a maximum height of eight feet and a maximum surface area of 64 square feet.

    2)    The freestanding light poles on the subject tract shall be limited to 20 feet in height and the lights shall have full cut-off light fixtures.

    SECTION 3.  This ordinance shall be in full force and effect from and
after its passage.
